Hi all

Just to let you know that my EAD is denied and I am very sure it is because of the mistake of code a6 instead of c9.

I have not recieved the notice letter yet so can't tell for sure what's going on :crying:

Sorry to hear about the EAD denial.

Hopefully, the notice letter you get will give you options on appealing the decision. It seems like you should be permitted to correct a coding error and still get the EAD processed.

Perhaps you can set up an InfoPass Appointment to find out if the mistake can be corrected. That way you save the time and cost of reapplying.

Sorry about your EAD, Mrs. Bird. That lawyer of yours.... grr! :angry: Make sure they keep to their word and pay out of their own pocket to refile... and get them to do it ASAP (or reimburse you if you end up filing yourself), why should you have to wait because of their incompetence?

Just checking in here to see if any of you June filer types have been transferred to CSC yet (anyone?), and just wanted to say that you should start seeing some transfers soon if you haven't already. I'm a last-day-of-May filer, and my AOS was transferred to CSC on July 3rd, a few days after my biometrics appointment. So hopefully you'll be getting some transfers (as well as interview dates) soon! :thumbs:

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

This is precisely what I advocated to myself when doing my AOS and to others: despite using a lawyer, always double check what the lawyer does, understand the forms yourself and take a more hands-on approach. An error that comes to mind was the lawyer wrote my I-94 number wrong... a huge mistake in my opinion and such a stupid one at that. Just careless. Which appears to be what your lawyer is.

You should absolutely talk to your lawyer and it it were me, I'd be pretty pissed off. He made a very careless error that was so easily avoided.

Aww Mrs. Bird... (F) Definitely give that lawyer a piece of your mind, and see what you can do about re-filing to Chicago before the fee increase at the end of the month.

Thanks Feather! I've been watching our case status every day just for the heck of it. His biometrics is Saturday so I guess if he's gonna be transferred we'll hopefully know soon. I am SO hoping for a transfer. *fingers crossed*

I think that featherB makes an excellent point. When you're lawyer gets back from vacation, you should absolutely talk to him about the erroneous entry in section 16 of the 765.

You are entrusting this lawyer to work out the system, and if he can't even get such a simple thing right, I would remain extra diligent with all his subsequent work for your case.

I assume that USCIS has already cashed the 765 check you enclosed at the outset? If you have to pay for another filing, I would personally insist that the lawyer absorb this cost.

When we catched his mistake earlier he said that on his expense he would ofcause pay if we needed to refile. So that's already a big relief for us.

But bad is that I can't get in touch with him before july 30 since he is out of USA.

Could you re-file for the EAD by yourself? Maybe lay down the fee yourself and make him reimburse you when he returns? My concern is that July 30th is the fee increase. EAD and AP will be included with the AOS application too... so I'm not sure what the procedure would be for applying for EAD only? And would the lawyer agree to paying the higher fee? There's so many uncertainties.

Good point. I would start filling out the 765 yourself before he gets back. I would also, however, wait until you get the actual rejection notice in the mail. It may have instruction on how to go about re-filing. I don't know for sure, because I haven't experienced a rejected 765 yet.

Well, we went for the biometrics appt this week and were in and out in less than an hour. No problems at all. The man who took his pic and fingerprints said now we just wait.

When we got home we had an email that the W-2s I sent in, in response to the RFE, have been received and they will continue processing the application.

Now I guess we're waiting to see if we will or will not have to have an interview before they approve/issue the GC.... how do they decide who has to have an interview and who doesn't?

Anyone else had their EAD's transfered to CSC? and their EAD status go from pending at the office it was transfered to, then back to....this case has been transfered to another office for processing(CSC) then get another email stating that their EAD is now pending at the office it was transfered to??

i.e........ transfered to CSC twice and pending @ CSC twice as showing in my signature.

I swear, i'm going insane here :bonk:

Hi everyone :)

I have just recieved an email from our lawyer from his vacation in Denmark.

He is telling us that he have heard from his assistent that my EAD is denied because of that my K-1 was expired and we gotta refile with a new code.

On my son's they are able to correct the code since he filed his application in time.

He tells that his assistent will prepare a new application and will mail this to us today to sign.

And also that he ofcause will pay the fee.

Then we are ready to file it again as soon he is back on his office.

I am so happy and reliefed that it wasn't more worse and that he took his time to think about it on his vacation
