I have send our AOS/AP to Chicago

And EAD to CSC.

I haven't heard anything from CSC about biometric yet

Does any of you go through CSC by your EAD application?

Why did you send the EAD application to CSC?

Actually I don't know.

We are having a lawyer and he is taking care of all this

We guess that he knows what to do

And they have responsed by a reciept. But nothing since

Your timeline says you came in on a K1? I hate to say it but I don't think your lawyer looked at the instructions that came with the EAD form.

Your category for the EAD is ( c )(9):

Family based non-immigrant categories

K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6).

File your EAD application if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under ( c )(9).

Then under Part 5 Where to File it says

If your response to question 16 is ( c )(9), file your application at the same local USCIS office or Service Center where you submitted your adjustment of status application.

So according to the instructions... your EAD should've gone to Chicago along with your AOS and AP. :(

We don't know anything about the instructions. But at least we got the NOA from them and guess everything should be ok. Are just waiting for the biometric app

The trick in applying for EAD another place is that it sometimes goes faster than if you apply for everything the same place.

AOS is very often approved before EAD in Chicago and EAD was a waste of money to apply for.

Mr & Mrs Bird,

That's certainly an approach I've never encountered reading about K-1 apps. such as yours. I would however, suggest, in my humble opinion, to take a more hands on form of diligence with your filing (i.e., reading the instructions on forms and not casting your application to the four winds via your lawyer).

Despite your lawyers engagement to your filing, they're certainly human as well (most of them), and make mistakes. You are the second line of defense, per se, to look over and read and understand what you are signing and doing. And there is no question, that the lawyer doesn't have as much of a vested interest in your case as you have.

It might well be the case that your AOS would be approved before your EAD if you send it all in to Chicago (as per the instructions)... but (I hate to say it...) that is not a reason to send the EAD application into anywhere other than the place the instructions tell you to. If you're applying for your EAD concurrently with your AOS, the instructions very clearly tell you to send them WITH the AOS package, to the Chicago lockbox. :(

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Our AOS and EAD is send before my visa expired and under my instructions it says that in this case our code is an A6.

If send seperatly we should use our local office which is Laguna Niguel CSC

If you file for EAD using (a)(6), then I think you will get an EAD that expires with your I-94, ie 90 days after you arrived in the US. Which would be, what, 5th June in your case? (a)(6) is the one you use if you're filing for the EAD on the basis of your K-1 BEFORE you apply for AOS. If you're filing concurrently with the AOS application (which will get you a 1-year EAD), you're meant to choose (c )(9) and file to the Chicago lockbox. I'm guessing you'll get your EAD application returned, as the expiry date they would have given it (the same as on your I-94) has now passed. :(

My NOA1 for AOS is dates June 18,2007 and June 29 for my EAD since they sent us back our EAD application because we forgot to send a check..lol. But everythings OK now :)

July 16, 2007: Case Transferred to CSC

August 18, 2007: Biometrics Schedule :)

August 31, 2007: Card production ordered

September 8, 2007: Green Card received

Remove Condition

August 8, 2009: Mailed I-751 to VSC

August 21, 2009: NOA1 Receipt Date

August 31, 2009: Received NOA1 by mail

September 8, 2009: Recieved BIO date by mail (Receipt date 9/1/2009)

September 29, 2009-: Biometric Appointment

December 7, 2009: I-751 approved, card production ordered (10 Year Green Card)

April,28, 2011: MIaled N-400 Application (Naturalization)

Our AOS and EAD is send before my visa expired and under my instructions it says that in this case our code is an A6.

If send seperatly we should use our local office which is Laguna Niguel CSC

If you file for EAD using (a)(6), then I think you will get an EAD that expires with your I-94, ie 90 days after you arrived in the US. Which would be, what, 5th June in your case? (a)(6) is the one you use if you're filing for the EAD on the basis of your K-1 BEFORE you apply for AOS. If you're filing concurrently with the AOS application (which will get you a 1-year EAD), you're meant to choose (c )(9) and file to the Chicago lockbox. I'm guessing you'll get your EAD application returned, as the expiry date they would have given it (the same as on your I-94) has now passed. :(

After almost killing my lawyer today he just assured me that we have done our applications the correct way.

I can only hope that this is true and wait and see what will happen.

They have touched our EAD june 20 and would think that I will hear from them very soon if something is totally wrong.

I hope it will be ok. :) Might be an idea to post a separate thread about this, so that people who know more about this stuff can read it (I'm not sure many 'old hands' read the monthly filer threads!)... I'm just worried that because your lawyer chose (a) (6), there might be a problem... I hope not, though.

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png
