I think is impossible to tell who's getting their EAD and who's not based on their LO. My Local office is meant to be "quick", current processing times start at 6 months. However, my case hasn't been touched since my bio appointment (96 days ago). 

 Then I agree with you that the processing is just really random.. which is unfair😔

Attended the field office in Oklahoma City today for interview. Turns out they didn't have my I-130, which is still in Nebraska, so they couldn't interview us. So now we continue waiting while they get it, and then reschedule the interview. So bitterly disappointed.

The IO was really nice. The whole interview process with the IO took about 25 mins.

  • Started us off with an Oath.
  • Asked me questions from my application like current employers, length of stay at the current address, etc.
  • Asked me all the standard yes/no questions that are on the I-485 form
  • Asked my USC wife about our story. 
  • Asked about our families and if we met each other's families
  • Asked us about our health insurance and car insurance. They are separate.
  • Looked at our originals for birth certificates and marriage licenses. 
  • Asked and took some additional documents from us for joint accounts and photos.
    • Submitted a home lease agreement and joint credit card transactions that have both our names on it.
    • Submitted a copy with both of our licenses copied onto the same page.
    • Submitted individual bank mail with the same address on it. 
  • Told us we should expect the card in 1-3 weeks!

OMG! Have I made a HUGE mistake? Help!

 

We brought my fiance here on the K1 fiance visa, got married during the first 90 days, and then sent off the I-485 (Adjustment of Status) along with EAD and AP forms. However, we did NOT send in the I-130 as I thought that form was only for folks who were already married and wanted to bring their overseas spouse to US.

 

For folks who come here as a fiance under the K1 visa and then get married, should we have filed both the I-130 AND the I-485 or is just the latter all that was needed?

I-130 is NOT needed for adjustment from a K1 visa. The I-130 is filed concurrently with the I-485 for people who married in the US and are adjusting status from another visa type or on ESTA.

You do not need an I-130 for AOS from a K1. You're fine.

 

Although this is a subforum under AOS from K1/K3, the mods really don't enforce that strictly so posts from users asking about AOS from other visa types are rarely moved to the other one.

Cool. Thank you so much for quickly responding! That's the way I had always understood it to be but was watching an attorney on youtube and they were giving some confusing info. I'm usually pretty calm but I suddenly started freaking out. LOL

Thanks for your guidance. I had watched a confusing youtube video and then saw where someone else here had mentioned their I-130 and I suddenly felt like I knew nothing at all about the process. :)
