Uhm the OP has to be a USC to file the I-129F.... 

Yes, obviously.....I was trying to clarify that  due to the way he was asking if friends could find him a sponsor.....

The visa would remain refused. You can submit a new I-134 with a co sponsor afterwards. Just note that there is typically a few weeks or longer delay before they review any new materials...personally I would focus on finding a co sponsor to get over this hurdle.

they would also question How a person making only $18,500 can have $70,000 in the bank and they are allowed to say that

As others said you need a cosponsor. 

K-1 visa, while a non-immigrant visa is normally judged on the 125% of the poverty, NOT 100%. This is due to the fact that shortly after your fiance enters the country and gets married, you will then have to meet the 125% poverty level for AOS. It's much less work to ask for a cosponsor at the K-1 stage then let your fiance into the US only to be denied AOS if you can't find a cosponsor or can't make 125% of the poverty level.

If you plan on applying for K-1 again because you can't find a new cosponsor, then the safest way for approval is to make 21,137$ a year minimum. If your financial history is iffy, they can even ask for a cosponsor anyways, even if you make enough. Using assets are iffy and not all CO's will take it.

Your household would consist of you, your fiance/spouse, and any people you may claim as a dependent. So for just you and your fiance, you would need to make 21,137$ a year.

$70K isn’t for 1 year, I work whole life..

I-134 basically Sing page will be ok,if I’ll get  scanned from sponsor via email? With submitted documents I’ll print out

I-134 can be scanned, but co-sponsor needs to also provide evidence (tax transcripts) All that can be e-mailed. Have them print Page 5 of I-134,  sign it, then scan the signed page, e-mail you PDF of I-134 + scan of Signed Page 5 + Tax transcripts as PDF.  Do not worry about your 70K in the bank at that point, since they specifically ask for co-sponsor, give them that.

Thanks, yes there is just 1 page to be scanned, all others easy to print out... thanks... will see if I’ll find someone who will send me that.

Is the $70k asset cash?  Property?  401k/IRA?

 

If the $70K is an IRA/401K the amount of the asset is reduced by approx 40% due to taxes/fees.  Although no form specifically states that retirement accounts can be used.. they do state 'stocks/bonds', which technically an IRA/401K account is.

 

When you apply for a green card, you must meet higher financial amounts:

 

If you cannot meet the minimum income requirements using your earned income, you have various options:

 

You may add the cash value of your assets. This includes money in savings accounts, stocks, bonds, and property. To determine the amount of assets required to qualify, subtract your household income from the minimum income requirement (125% of the poverty level for your family size). You must prove the cash value of your assets is worth five times this difference (the amount left over).

It is best to always consider the 125% guideline even with just the I-134.  Some embassies and consulates will only consider the 125% regardless.  Not sure if yours is one but since the k1 is pointless without the AOS following it why not plan appropriately?

Then I had wrong info about fiancée visa 100% of poverty guidelines, now I understand that consulate required 125%, but it is what it is...otherwise there isn’t official guideline about I-134 that required 125%

The CO makes a decision based upon the totality of the circumstances, not minimums.

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.
