hello everyone ,

1) what is there in packet 3 so tht i can be prepared i m not receiving it in mail long time?

2)my local embassy in india insists on bringing tax details , my husband already submitted the main tax returns sheet up to date with i-864

we dont have those sheets now

do we have to again submit these tax documents copy at the embassy or will the nvc forward it with my ds-230

any idea can we get those tax returns print outs again??

An I-864 with Tax Transcripts should be fine.

2 major things in packet 3 are DS-2001 (Check list) and DS-230

http://www.state.gov/documents/organization/81807.pdf (DS-230)

The check list DS-2001 essentially lists what will be needed for the interview, and that you have them before sending the forms back to the consulate.

Lists things like Birth Cert, Police Cert, Marriage Cert, Divorce Certs, Death Certs, affidavit of support ect.

2. your husband can request from IRS new ones, maybe is an online service so you can get it fast

I summited my tax return when I got the RFE, it was a good proof that our marriage is bona fide because we have joint tax returns. At the interview, the Officer said they do not need a tax return because they have it already. ;)

What happens next?

On receipt of the forms DS-230-Part I and DS-2001, the NVC will conduct any additional processing required and forward the applicant's file to the U.S. Immigrant Visa Unit in India that serves the applicant's current residence.

After an Immigrant Visa Unit receives the applicant’s file from the NVC it will inform the applicant by mail about their visa interview appointment.

The petitioner and Form I-864, Affidavit of Support

The person bringing the beneficiary (applicant) to live permanently in the U.S., the petitioner, must accept legal responsibility for financially supporting the beneficiary. The petitioner accepts this responsibility and becomes the beneficiary's sponsor by completing and signing a document called an affidavit of support. This legally enforceable responsibility lasts until the beneficiary becomes a U.S. citizen or can be credited with 40 quarters of work (usually 10 years).

After the petitioner has paid the Form I-864 processing fee the NVC will send a letter with instructions to the petitioner. The petitioner should return a completed Form I-864 to the NVC. When the NVC has reviewed and approved the petitioner's Form I-864 it will be forwarded, along with the petition, to the appropriate Immigrant Visa Unit in India.

Important Note: The applicant and petitioner/sponsor must not download and mail any forms to the NVC until they have received official notification that the NVC is ready to proceed with the application. Forms received before official notifications will be discarded.

It is recommended to have copies of all paperwork submitted to USCIS and NVC with you at the interview, just in case something is missplaced in handling the case either by USCIS, NVC, and/or the consulate. They can and do ask fo any of the submitted paperwork, that includes the I-864 and attached financial evidence.
You should have the originals on hand at this point for the Final Interview. Per the Foreign Affairs Manual (FAM), they may also be unavailable. Or certain countries don't have individual birth certificates as understood in the US, but the FAM will describe the suitable document. The consulate can explain the alternate requirements to the beneficiary in detail.

Mala,

You don't need to bring tax transcripts for the Embassy, as your husband has already submitted them to the NVC in USA. NVC will forard everything to the Embassy. However, it is a good idea to keep all copies with you and review them. Sometimes, consular offices asks questions from them to check, if the spouse is aware of all information. Plus, as YuandDan said, you can point them any spelling errors, if there is any. You also don't need to bring any IV Bill for the interview, as your husband must have paid it to the NVC in USA.

SHARING SOME INFO REGARDING DELHI EMBASSY PACKET 4 CHECKLIST REGARDING TAX TRANSCRIPTS TO BE SUBMITTED TO VFS OFFICE ?

AFFIDAVIT OF SUPPORT:

Applicants should check with their sponsor to see if form I-864 has already been submitted to the National Visa Center (NVC). If so, it is not necessary to submit another I-864.

A) Immediate relative and family preference category

Each immigrant visa applicant needs to satisfy the consular officer that he/she will not become a public charge. In all immediate relative, family preference, and employment-based applications (in which a close family member owns 5% or more of the petitioning business), the petitioner must submit a completed Affidavit of Support (Form I-864), no matter what his/her financial circumstances are, to show that the sponsored applicant(s) will not become a public charge.

i) If form I-864 was not submitted to NVC the applicant must submit the following from the petitioner (sponsor):

a) Form I-864.

B) Evidence that the household member is a U.S.citizen /U.S. permanent resident if a form I-864A is submitted.

c) Federal tax return (form 1040) with all W2s and supporting schedules for the most recent taxable year.

d) If the petitioner did not file a tax return, then the petitioner must provide a written explanation of why he/she had no legal duty to file the return.

e) If the petitioner filed a late or amended tax return, he/she should submit evidence of it.

f) If the petitioner does not have copies of his/her tax returns, an Internal Revenue Service (IRS) summary should be submitted.

ii) If the petitioner's income or assets do not exceed 125% of the federal poverty guidelines, then an I-864 of an additional sponsor willing to assume financial responsibility for the sponsored immigrant(s) must be submitted. This additional form I-864 must include all the supporting documentation indicated in section (i) above, as well as evidence that the Joint Sponsor is an American citizen or Legal Permanent Resident.

iii) If the additional sponsor lives in the same household as the petitioner, he/she is considered a household member, and cannot fill out a separate I-864. The household member must execute an I-864A, as described below.

iv) If a sponsor wishes to qualify using the income or assets of a spouse or resident of his/her home, in addition to the above documents he/she should also submit form I-864A for each additional contributor. The additional contributor should sign the form I-864A as the household member. Each household member should submit a form I-864A along with all the required documents outlined in paragraph (ii). Please note sponsor must include household member income in part 4 of form I-864.

v) (a) Applicants are responsible for providing sufficient copies of the form I-864. Beneficiaries of immediate relative (IR) petitions must provide one original signed -864 and one complete set of original supporting documents. It is Embassy's general languages. You will only take those originals, if your husband had not submitted those to NVC. When NVC completes your case, it will send all documents to the Embassy. So you are not required to take them. When you will receive your interview letter, it will say more clearly that if your petitioner has already submitted those (I-864), you do not need to bring them with you. Please relax and do not worry about them at all.
