Applying for the I-130

Hi all I’m currently preparing my I-130 application/documents and am ready to submit...my question is if you have a Child but they will not be moving to the United States with you do you still need to say that you have a child in your application? My child lives in another country with his mother and is not physically apart of mine or my wife’s life due to certain circumstances..

Also curious will I the beneficiary or the petitioner be required to submit our tax returns or is that something that may or may not be requested during the process?

Petitioner needs to submit tax returns.

If you are the beneficiary why are you doing the I-130? That’s for the petitioner to do.

Then you both need to understand that the I-130 is a petition to be filed by the US Citizen petitioner.  It is not an application for anything.  Become A-students of the I-130 instructions and all form instructions as you go through the process.

 

Adhere to this concept.  The questions on the form are questions.  Answer the actual/literal question being asked.  When asked to list children, list children.  This will happen again when completing the "visa application".  On that form, you can indicate whether a child will be immigrating with you etc.
