Form I-130

Hey guys, just filling up the form now we will be applying for CR1/CR2 (we plan on relocating with two kids) - going through the I-130 instructions it said that we are not required to file separate petitions. Does it mean I can fill in one form and put my two kids name on Part 4 or do we have to have 3 separate form? Also, I have read that I don’t need to send passport sized photos for my kids?

Your spouse is a 1a.   She also needs the I-130A.  The kids are 1b.   They are not derivatives in this process.  I-864s for each of them.

What do you mean I-864 for each of them? Also, hubby don’t meet the financial requirements however, my in-laws are ready to sponsor me and my two kids. Question is my mother in law work and earns 27k for 2018 and my father in law is on social security for disability benefit and had 13k for 2018. Combined will be 40k which I believe would be able to sponsor us 3? Would his benefit be counted as income?? Thanks.

Each will need a I-864 from the petitioner, the sponsor and I-864a from the sponsor's husband.  Include tax transcripts for all of the sponsors.

Right. So if I understood it right, my in laws would be filling in 3 forms of I-864 and I-864a? Does my husband need to fill in one too? He lives with me in the UK so since his mum and dad meet the financial requirements can he stay with us throughout the process until we get our visas? Many thanks for responding. We have an active US bank account both in our names and have bought a property as well which pay taxes on. Will that be enough to establish domicile?

Yes and copies of their tax transcripts

You need those for the interview.   

 

For now you file the I/130s and you I-130A

Yes that is pretty good.   Again, not needed until the interview.
