I'm not trying to give you a hard time. I really hope there is no delay, I'm just being realistic. Hopefully you can get into the embassy and hopefully they look at your paperwork and say it is ok, but worst case scenario they send it back to USCIS - be prepared for that. Research your congressman as they will be the best to help you if it gets sent back. 

 

Please keep us updated as to what happens! 

called the embassy and they said to send a explanation through their online contact form and they will respond back to me on how to proceed with the documents.

 

Probably will  end up presenting them in the interview.. and the fact papers didnt include him living in my house was my luck.  its not domestic violence haha.  even though at the time he was technically in my house, he didnt state it.

Definitely uscis stage for petitioner's background check..    Just hope for rfe and start to gather the documents as early as now..

Just to note,

 

I contacted my congressman after USCIS said they can not do anything with a closed case.  They read the court documents and letter from my step brother.  They agree it shouldnt have been done and that it was a honest mistake.  Had to fill out a policy release form and write a statement explaining the mistake and they are forwarding to uscis.. biggest thing is to try ti show the issue was disclosed asap upon learning of it.  To present in the interview to hopefully  avoid a denial for failure to disclose information.  We all know the returned i129f policy  is to let it expire.

Instructions also mention IMBRA requires required disclosure of only permament orders.

Little follow up on this.

 

 

presented no issue.  USCIS and NVC (after sending it to NVC) and consulate even after mailing them.. informed me it is not needed.

 

Visas in hand as of today.
