Timeline

Hi Everyone! My fiance arrived here on April 27th and we're in the throes of planning our July 7th wedding. I just learned this morning that our marriage certificate won't be recorded the same day even if we brought it to the office ourselves and waited. In fact, it might take several. We had been planning on obtaining it that following Monday as well as sending out the behemoth AOS package and hightailing it to Maui for sun and frolic ASAP and make in home before my fiance's 90th day, which is July 25th. Even though we don't have a certificate in hand, are we indeed in the clear? Will my fiance suffer any legal repercussions if we send out the AOS package upon our return--and dangerously close to the 90th? Should we delay our honeymoon( :( ) until the certificate is safely in our hands and the AOS package is sent?

I've searched the archives and can't find a similar situation. Any help would be greatly appreciated.

AOS fee will go up to $1010 after July 30 so you may want to file ASAP.

You only need to marry within the 90 days.

Last time I checked Maui was still part of the USA, so you don't go through immigration on your return, right? So the 90-day concern is moot, assuming that this is what you were concerned about :-)

I don't think you have anything else to worry about unless your soon-to-be wife's plane ticket is booked in her married name. She will need photo ID to clear security. That photo ID (her passport presumably) is almost certainly in her maiden name, so if the ticket is booked in her married name, then you will need to carry a certified copy of the marriage certificate with you.

Sending out the AOS package beyond the 90-day validity of the K-1 is acceptable, other than the fact that you'll have to fork out more cash if you file after July 30th.

If I was you, I'd talk to a supervisor at the local courthouse and see if you can get it registered sooner. This is what I did and they walked it through for me on the spot. If you can do this, then you can get your AOS package off in the mail before going on honeymoon. Make sure to get a few certified copies. Saves you going back later if you need more.

Like the others said before, you don't have to worry about filing right away to be in the 90-days limit. That is only for the wedding itself. You can file for AOS later on.

The sooner the better, but I am sure, a little delay due to your honeymoon won't do any bad to your case.

So don't worry and enjoy your wedding and honeymoon!!!
