K1 Visa stuck on background check 16+ month

Hi, please advise as what to do if anything at all. So I filled my papers back in December 2017 and received my noa1 1 week later. Since then I waited and checked the processing time at their website i.e estimate 6-9 months. After 6 months I started to call them asking where or what step is the process at. To which they respond just wait and call us back next month or wait 30 days. Month after month I called only to be met with just wait. Finally I did an inquiry to outside processing time to find out I'm stuck on background check. So I figured at the most maybe 1-3 months. Now it's over 1year and 4months. Now I'm invoking the help of a senator only to have her responded with wait additional 45days. Has anyone been stuck as long as I have?

What paperwork are you referring to?  Many people here are glad to chime in if they know more.  Our AOS is 15 months from NOA to Interview.  Our 129 (K1) was just under 8 months.  Times for everyone is stretching out.  It also depends on where something is filed, etc.   Once I seen others who had the same NOA Dates as we did, and they ere getting their appointments,   I had an account on the USCIS.gov site, and emailed them.  They said it would be 3 weeks to hear back, but in the meantime, we were scheduled for an Apt for AOS.  It's a waiting game for sure.

Q1. Hi, please advise as what to do if anything at all. Contacting your congressman is a great avenue to use but keep in mind it works for some and for some it is still a waiting game.

 

Q2. Has anyone been stuck as long as I have? Yes others have gone through what you are experiencing. Here is another topic with the same or nearly the same as you.

Has the file been sent to Vermont? Am I reading this correctly that you are still waiting for the I-129F to be approved? We are not talking about embassy-level AP post-interview here?

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes I am still waiting for a response before it's approve for Vermont. It's been 2 frustrating years with nothing but radio silence.

Have you contacted your senator or congressman?  Have you contacted the USCIS ombudsman?  

Those would be some great starting places for you if you haven't yet.  But if you have, I'm sure there are others with better suggestions for you.  I"m sorry you've been stuck in a black hole! :(

It's a first time in hearing about ombudsman. Well if nothing gets done with the congressman then I guess I will use ombudsman. Thank you.

We sent a letter to Ombudsman in February and since that time we didnt get an answer except their letters about nothing and advising us to have patience we((( it may take  90 to 120 days to make an inquiry about your case to USCIS.

I would go with the ombdusman right away... As someone else posted they are a little backlogged so it can take a while to get an answer.

You might try both options below. 
 
First try submitting an inquiry using this link from the Ombudsman; submit your request online.  If you have already submitted online but did not receive a confirmation email with your case number, the submission did not go through.  Please try again.  
  
If you have not submitted Form DHS-7001, Case Assistance Form, online or made other arrangements with our office to file on paper, we will not respond to any emails.

If you receive a response and it contains anyone of these sentences this will be the meaning of that phrase. 

If the CSC response is due to a congressional case worker inquiry, the service center will say "security checks" 

If the CSC response is from a regular service inquiry from their website, the service center will say "adjudication"

That is excellent news!

 

Timeframes vary; however I just got approved after 582 days of waiting (Oct 17 filer). We received our approval a couple of weeks after USCIS received our response.

 

I am sorry you’ve waited so long, I know EXACTLY what you are feeling. Hoping you receive your NOA2 as soon as possible, keep hanging in there!
