Hello . I am filing for my husband and I am at NVC stage , I am using a co-sponsor and he filled his tax jointly with his wife , he filled out I-864 and his wife filed I-864A, my question is do I have to send his w-2 ? He didn’t have it because he lost it , he can asked a copie at his job but that can take another week to get it , or I can just upload document without it , I have his tax transcript 16,17,18. Thanks

I only uploaded co-sponsors tax transcripts for 16-18. I was approved. Make sure you upload them separately. Have your co-sponsor request W-2 and take to the interview just in case. Good luck.

Tax transcript is sufficient enough, I sent both W2 and tax transcript but either one would of worked.

A W2 is not a substitute for a Tax Return Transcript.  A W2 is PART of a complete copy of a tax return.  W2's are not needed with Tax Return Transcripts, but it doesn't hurt to include them or take them to the interview in case.

Thanks sir . I paid my fees yesterday , maybe by Thursday I will be able to upload everything

Actually they asked for my joint sponsor w2 last week. They want a w2 for each transcript submitted.

I used my mom and her husband. They rejected her husband bc the tax transcript doesnt hv his entire name on it. They filed together. The transcripts only hv his last 4 letters of his surname and initial.

 

I had to request tax transcripts in his name and upload his transcripts, w2, proof of citizenship and domicle separately. 

 

Thank goodness I got the transcripts online.

I think this whole process really depend on who review your case

For financial support on behalf of the beneficiary, they are looking at the totality of the evidence, to determine the likelihood that the beneficiary will become a public charge.  The more evidence you and the co-sponsors send to convince the CO of this, the better.  NVC is just checking off boxes to make sure everything on the list has been uploaded or submitted correctly.  The CO at the interview will make the decision about the visa based on what you upload to NVC, often they make a preliminary decision before the interview and don't even look at additional documents the beneficiary brings.  They are getting more strict about the public charge issue and are scrutinizing cases more where the petitioner does not have sufficient income and uses a co-sponsor because after the beneficiary arrives in the US, often the co-sponsor is unwilling to pay for unexpected and expensive medical care, for example, so the US taxpayer foots the bill.  The Trump administration has issued guidelines to the DOS to crack down on these situations by strictly interpreting the law at immigrant visa interviews.  We have recently seen all kinds of examples of this here on VJ, very consistently around the world.  It's because of a formal directive from the very top, not person-specific.

Thanks for the clarification . If the C0 look only at my current income is all over the poverty , I am at $76000 for family of 5 including the beneficiary with my 2 jobs combined for this year . Last year I didn’t make enough because of too much travel and my kids being sick . Thanks again for your input

My household income is 108k for a family of 3. I put everyone living with me.
