Hello all,

I have my citizenship interview in a few weeks and am wondering if there is a way that I could get my child's exit and entry dates into the USA since 2014. I do not have custody of him. I am trying to decipher in bank statements but it gets a little hazy for some dates.

You don’t have custody of him, can’t you ask whomever has custody? In any case for the child you can put in your best honest guess from what you can get. It’s the immigration officers responsibility to access the information from their databases if he/she is inclined to check.

Also note that the dates are used to check the physical presence and continuous presence requirements. Thus any errors of a few days or even couple months here or there that won’t affect their ability to satisfy those requirements are not material. Nobody is going to accuse you of fraud or material misrepresentation if you give it your best honest shot and are off by a little.

I'm not worried about that for me, this has more to do with when my son was visiting and I am trying to nail down dates so that I can use bank statements to prove that I provided for him while he was visiting. I have a few photos but thinking that that entry/exit records with photos and bank statements will suffice.

Does your custody agreement only stipulate that you provide for your child when he's in your care?  If so you can provide your bank statements and see if his passport has entry and exit stamps. You can look up his I-94 online.

If you do not have any sort of formal custody agreement with your ex, you should get a notarized letter from your ex describing the custody agreement you have between the two of you and show evidence of how you've kept to that.

Did your child fly or did you drive to pick up?  I have every itinerary of my child since I moved going back and forth since it was faster to fly than drive.

Otherwise they may ask for a formal custody agreement and proof you've sent regular child support payments.

I have sent support payments on a regular basis and confirmed whenever traveling to see my child or my child traveling to see me that grandma is okay with me using support to care for him while visiting or for me to visit him. I already have bank statements just need to iron out dates as mentioned in a previous post so that I can provide those bank statements as well as his exit/entry record and photos to prove he is with me. I am in the works of getting the exit/entry record as he just got a new passport. I have also already printed the written agreement between grandma and me, there is no court order, as well as working on grandmother hopefully getting me a notarized letter before my interview. I also have an email printed off from August 2018 saying that I am up to date on support. Thank you for your reply.

I also don't have a court ordered custody agreement so I think of all the things I would need to also send in for naturalization.  Part of which why I haven't. 4
