K1 Visa and EAD at the same time??

Hi everyone,

I just found VJ a few days ago and it is extremely insightful and useful!

I was wondering if anybody knew whether you are able to apply for EAD at the same time as applying for the K1 visa?

My plan is to apply for the K1 and have the EAD so I can start working as soon as i arrive in america on the K1.

November 8th....NOA2

December 8th.....Packet 3 Received (Sent back 10th)

January 8th.....Packet 4 Received

January 16th.....Interview in London

January 20th....Flight to AZ via JFK, received temp EAD

March 10th...I485, I765 & I131 sent to Chicago

March 22nd....Received NOA for I485, I131 & I765 (All dated March 18th)

March 24th....Received Biometrics Appointment Letter (dated March 20th)

April 7th...Request for Initial Evidence for I485 (Received in MO on the 10th)

April 9th....Biometrics Appointment

May 30th...EAD Card Production Ordered and AP Approved

In other words, your plan is to enter the USA at JFK airport in New York.

If that is not your plan you need to change plans.

EAD can only be applied for after a K-1 enters the USA.

Note: Some POE stamp the K-1 visa with the EAD stamp when they enter the USA, JFK airport is one. You then can apply for EAD after marriage and adjust status.

Note after July 30 the fee to adjust status will include EAD and Advance Parole.

How far along are you on getting the visa? Your timeline tells us nothing.

I wasnt planning on entering through JFK, but i have heard that if you enter through JFK in New York, they always give you the EAD work permit stamp? is this true? or are there any forms you can fill prior to arrival so that you can have the EAD upon arrival on the K1

:lol: You can enter through JFK and get a temporary work permit good for 90 days. Just get married and file AOS and EAD soon after and there shouldnt be too long (if at all) where you dont have a valid work permit. Pretty sure you can't file EAD while the K1 is processing.

If you do decide to fly into JFK, don't go via Dublin. You will clear immigration there and will not receive the temp EAD at JFK.

Definitively, no. If you want immediate EAD you must enter through JFK and get the EAD stamp. Make sure to ask for it or insist on it if necessary. If working right away is that important to you and you can actually work right away if legal, then it is worth it to arrange your entry through JFK making sure not to travel through any foreign airport Dublin for example) where you would clear US Customs before your JFK arrival.

It is one of those unknown things, USCIS suggested that K-1's are work authorized by default with or without EAD stamp to SSA for Social Security Number purposes, so virtually all airport POEs stopped stamping the I-94 card with the EAD stamp with the exception of JFK, and they can discontinue the practice at any time.

Yup. It doesn't matter if your I-94 is stamped "Work Approved" or not, so long as it has a valid entry stamp. It automatically becomes your temporary employment authorisation.

Don't try to apply for a Social Security number within the first week of entry. You won't be on the computer system, and you'll be turned away. Go in a week after entry and enquire if you are on their computer. If you aren't by then, make noise and get them to check more thoroughly- they do have paperwork records too but they have to search. You are on a relatively short time frame for getting a Social Security number with an I-94, as they can't issue one within the first 7 and last 14 days of the I-94's validity.

Most likely they will try to turn you away if they don't see a "Work Authorised" stamp. Insist upon speaking to the branch manager and push your case if the desk clerk tells you you aren't allowed a Social Security number. Don't accept their word as the truth!

We've been through this already, and it took the Social Security office here longer than the I-94 was valid to go through their records and discover that they could have issued a Social Security number with an I-94 that isn't stamped "Work Authorised". Because it had lapsed, they couldn't issue one, despite it previously having been valid.

Trust me. You don't want to have to wait twiddling your thumbs whilst your EAD paperwork rolls through. Get them to check. We're being used as a training example now for the office on what not for them to do. Sad but true.

So yes, long story short, your I-94 is your temporary work permit until your Dept of Homeland Security Work Auth card comes in.

The news just hasn't spread to all Social Security offices yet.

As far as I know you can work only for the 90 days that your K-1 Visa is good for and after the 90 days you have to stop work until you get your New EAD approved when you file your AOS. The AOS, EAD and AP are all in one filing now and will be affective July 30th 2007

I find this to be a very confusing subject. At the end of my interview the gentleman handed me a sheet with answers to questions. On that sheet it said that your visa comes with a foil inside it and that foil gives you the right to work.

Why do they make this subject so confusing?

I HATE miles, gallons, pints, words spelled without u's, and all that other jazz...
