Hi everybody,

 

Quick recap: filed AOS after coming in on a K1, have receipt # and NOA1. Interviewing now and hoping to get my EAD expedited through it.

 

I successfully interviewed for an organization in MA, their policy is they sent me what they call a 'contingent job offer letter' that clearly states 'This offer is strictly contingent on the successful receipt and completion of the below items'

 

The items being:

 

A. A complete background check.

B. A complete driving record check.

C. Proof of auto insurance is required.

D. An education verification form. 

E. DCF CORI form. 

F. References

 

Should I try expedite my EAD yet based on this job offer letter? Or wait until A-F are satisfied and get a 'cleaner' letter?

 

Anybody have experience with this?

 

Additionally: Number B is requiring me to provide my US drivers license #. I have my road test planned for June 3rd (have prior obtained US DL so not worried about it), but my I94 expires on June 9th. My learners permit was made valid until June 9th also, and Im expecting my DL will then also expire 6 days after I obtain it? Don't know how to fix that?

Feb 28: petition sent

March 12: NOA1

October 10: NOA2

Feb 5 2019: Interview (approved!)

Feb 12: Passport received, visa in hand

March 12: enter US, POE; Boston

March 21st (1st day of spring🌻😞 married!

AOS (2019) 

April 12: Sent in AOS, EAD and AP

April 15: Delivered at USCIS

May 15: Opened service req for NOA1

May 20: NOA1

May 30: Opened service req for biometrics appointment scheduling

June 6: Requested expedite processing on EAD (via phone)

June 12: Asked to fax evidence for expedite, sent in job offer (non-profit) and cover letter

June 17: Received RFIE (birth certificate) - notified that EAD expedite was on hold

June 20: Evidence received by USCIS after overnighting

June 21: Asked for expedite request to be re-activated (via phone)

June 26: Expedite could not be completed because of missing biometrics (E-mail)

June 26: Biometrics appointment got scheduled (for July 9)

July 3: Walk- in biometrics

July 8: Asked for expedite request to be re-activated (via phone)

July 13: Expedite request for EAD was approved (E-mail)

July 17: Hard copy of Notice of Approval for both EAD and AP in snail mail- online status changed to card was mailed to me 

July 20: EAD/ AP combo card in hand

you need an actual job offer. have you completed biometrics yet? they wont consider an expedite until you do, so far as i know.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

 

ROC

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Please explain what you mean with 'actual' - they have given me an actual job offer it is just contingent on a background check. So would your suggestion be to wait for the less contingent job offer as I am guessing by your reaction?

I had my case expedited with a formal written job offer. So it is possible! 

Met: Aug 12, 2016 in San Diego

I129F Sent: Feb 25, 2018

NOA1: Feb 27, 2018

NOA 2: Sep 5, 2018

NVC Number Received: Sep 24, 2018

File Received at US Embassy London: 

Medical Date: October 24th 2018

Interview Date: November 13th 2018

Approved!

As long as you've done your biometrics, expedite as soon as possible and don't wait for other extraneous employment-related tasks. Not worth it, your expedite probably won't be completed before they've already completed all of those tasks anyway. 

2015-11-23: Last TN received at CBP

2017-06-12: Married

2018-06-25: Mailed I-485, I-864, I-130/I-130A, and I-765 to USCIS

2018-07-24: Biometrics appointment

2018-08-28: Expedite request submitted for EAD via USCIS support line

2018-09-21: EAD and SSN received in the mail

2018-10-31: Interview is scheduled

2018-11-21: Last TN expired

2018-12-11: AOS Interview - Card is being produced

2018-12-18: Green Card received

2020-09-23: Mailed I-751 to USCIS

2020-10-03: 18-month extension NOA 

2020-10-15: Biometrics from AOS applied to ROC

Probably can't fix it until you get the EAD....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Depending on different companies' policies, there could be considerable difference between a contingent job offer and a formal written job offer.

 

Here are the USCIS expedite criteria.  Does your request meet the criteria?
