Question regarding eligibility to sponsor since I have previously sponsored an ex-husband

I can't seem to find any direct information on this, hoping someone here can help.

 

I was originally married in January 2007 to my ex-husband. He is English and I moved to and lived in England from 2007-2011. In 2011 we moved to the US together and I sponsored him on an IR1 visa. We lived together in America until 2015 when we filed for divorce. Our divorce was finalized in August 2016. We tried, but our marriage failed.

 

I met my current husband in 2015. We started dating in 2016, were engaged in 2018 and were just married earlier this month. 

 

I'm still technically my ex-husband's sponsor and I looked into it, without a court trial there isn't much I can do there. And I don't really want to do that as he does have a life here now and it is my understanding that legally, he is allowed to continue living here since our marriage dissolved and there was nothing illegal done. He is on a 10 year green card until October 2021 or he could apply for citizenship before then. 

 

My 2 questions:

1.) Is this going to hurt my current application? It didn't intend to fall in love with 2 foreigners it's just what happened. And since my ex and I were married for so long, I think it's pretty evident that it was a true marriage. Do I need to take any other steps when applying?

2.) On the application (I-130) it asks if I have sponsored anyone else before and on what date. I have ZERO clue what date it was. And I doubt I have any of that paperwork still. Is this something I can call to look up? 

 

Also, I welcome any other advice or suggestions here. I'm kind of at a loss!

My case is similar, My wife a USC was married to a foreigner and filed a petition for him and he got his GC, AFTER 5YRS of marriage, they divorced . Fast forward, we got married (Am also a foreigner) and my wife file a petition for me, at the interview, it was never an issue. 

 

Since you can recall the date, i would suggest you just answer YES and put the year, however on the last paper of the form I-130 supplementary information, you can write a note explaining that you can recall the date and month. 

 

Finally, if your relationship is genuine,  gather evidence and prepare well for the interview.

1. no effect but you will have to disclose it 

2. get as close as you can and add supplementary information explaining. You MAY be able to call USCIS and get some info, but im really not sure on that. 

 

and make sure you have LOADS of SOLID relationship evidence.

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/19/21 Received Text NOA1

We definitely have loads of relationship evidence. We spend spend between 1/3 and 1/2 of the year together and have been doing so for almost 3 years now So I think we are good there. And I'll definitely be sure to disclose everything.

 

I was so worried this would result in a hard no during the interview.
