USCIS vs NVC/Department of state

What are the rolls of each? USCIS-NVC/Department of state. Do they do similar background checks? What are the differences in their background checks?

USCIS processes petitions, applications, and other requests within the US.

 

NVC is basically the go-between between USICS and DOS. They receive petitions and other requests from USCIS, prepare them as necessary for the specific consulate, then send them there. It's administrative stuff. For a K-1 specifically, they just assign a case number and such then pass the approved petition along to the consulate.

 

DOS is responsible for the embassies and consulates. That's where visa applications are made and where visas are issued.

 

Edit: For a K-1, USCIS is focused on and responsible for the the I-129F petition. background checks and such would be about the petitioner.

NVC doesn't do them.

DOS will do them on the visa applicant.

Each of these agencies, USCIS and NVC, are parts of their respective federal departments, DHS and DOS. The Immigration and Nationality Act of 1952 (and subsequent amendments, changes to the allied laws and regulations) prescribes the duties and responsibilities of each of the two federal departments in carrying out the legislation passed by Congress, to govern immigration and citizenship in the United States.
