That's news to me, because K's aren't allowed to work without first applying to EAD. Please provide the instructions you are referencing.

K-1s are allowed to work with authorization. That's why every K-1 checks "alien allowed to work" and on the SSC it will state "only allowed for employment with DHS authorization". And that authorization is the EAD.

Thanks Scandi. That is clear now, as I have stated in my follow up comments to the old comment you are quoting. I was failing to differentiate between the words allowed and authorized.

K1 is allowed to work with authorization.

So your ssc will have an annotation stating that .

You can follow the guides on this site to how to apply for SSC. I think they have a mock filled out form too, but always download the latest from USCIS and do not edit the mock file.

Thanks. Got that cleared up this morning. I don’t have any questions about SSC, I’m not the original poster. I’ve already got one.

Thanks for correcting my misinformation. I see now that we should check the "Allowed to work" box. We will do that.

The moment you get SSN, assuming you still have 60 or more days on your I-94 left, head to CA DMV. You should be able to get State ID without any issues. For DL you will need to pass knowledge test and behind the wheel test. Bring your marriage certificate as well as utility bill, (car registration from your partners car should work too)

I realize there is variation based on people you deal with, I believe anyone in CA is able to get AT LEAST AB60 driver licence https://www.dmv.ca.gov/portal/dmv/detail/ab60

We were able to get State ID (expires in ~5 years) but it is not a "Real ID" before we even filed for AoS but after marriage as well as learner's permit. I see no harm in trying regardless.

Not to beat a dead horse, but here's the documentation from the SSA's POMS directly covering what box to check:

Bring passport/visa, birth certificate and I-94.

They will send you the card about 2 weeks after US arrival. They have to wait for DHS confirmation, then another two weeks to mail.

When you get your SS card it will say on the front "VALID FOR WORK ONLY WITH DHS AUTHORIZATION"

Which means you will have to present SS card along with EAD or GC to the employer to be able to work.

Save the headache and just bring those things to the SS office.

And you only need your passport and BC to get a marriage license.

In CA, you definitely do not need an SSN to get married. And your fiance's passport is acceptable ID.

Anastasia and I got married in CA three days after her POE; she did not have an SSN (she'd applied for one the previous day) or any US-issued ID yet.

That would be a false statement. According to his timeline, he has not even filed for AOS or EAD. So he is not allowed to work.

OP, you don't need a SSN to get married. You probably will not be able to get your California ID until you are married and have a SSN. From what I understand, all K1s are allowed to get a SSN during a certain time period. But a lot of the situations I have read about are how the SS office delayed their applications for long enough by using manual verification that by the time the office got around to their applications, if they didn't lose it first, the time period was up for the K1 to get the SSN. So the K1 just had to wait until they had EAD or GC.

This is all true as @junkmart stated. Only passport needed for the marriage here in California. If u entered K1 file your Aos paperwork after marriage.  And play the waiting game like the rest of us K1s. It's not bad just have patience.

requirements needed for applying ssn.. saw this on visajourney.

1.
The SS-5 form you downloaded and filled out (they have some at the office if you forget).
2.
your Passport (with the K-1 Visa in it)
3.
your valid I-94: Electronic I-94 Copy; or (for older entries) an original (and bring a front/backside copy) of a valid paper I-94
4.
another form of valid ID (as defined in the SS-5 instructions)
5.

You should also bring the document RM 10211.530 that you printed out

i dont understand the number 5 above. Its from ssn site. Should i print it all out? What for is this?

And can i give passport instead of ID?

If you can spend some time listening to suggestions and not stick to your untrue belief..

k-1 visa holders are allowed to work with work authorization. So you check “alien authorized to work” option, regardless of whether you intend to apply for EAD or not.

That option you are sticking to is for people who aren’t authorized to work at all and will have “NOT FOR EMPLOYMENT” printed on SS card.

thanks for the info! how long can i get my ssn card in sacramento california?i wil apply for ssn on monday. and we're planning to get married by the next monday or tuesday.  is it possible to apply for marriage license without ssn card?

It's the SSA's POMS page describing that a K-1 holder should be issued an SSN, and the documents that are acceptable as evidence of status.

It's not required by any means, but can be good to have in case the SSA worker incorrectly tries to deny you for the wrong documents or if they say K-1 doesn't qualify.

Yes. Many people - in every US state - don't qualify for an SSN (visitors, people who jumped the border, etc.) but get married.
