On the Affidavit of Support i-134 it clearly states do you have any dependents now I have two children that does not live with me and I do not claim them on my taxes what should I do

They still count them on the Affidavit of support. Rather or not you file them or not. Even if they don't leave, still apart of your family.

You are required to list them.

What Part and question number?  Part 3 #10??

 

i wouldn't list them unless you fully support them or partially support them. They are trying to determine how many mouths you have to feed on your salary. If you provide no monetary support to them, then they aren't dependent on you. It says--

The following persons are dependent upon me for support.  

This is different than a question asking you to list your children.

The I-134 is ambiguous with this question. It only specifically says to include those who are wholly or partially dependent upon you, but doesn't specify what qualify what that means for a child.

When ambiguous on the I-134 (it happens a lot), I typically refer to the I-864 instructions. The I-864 instructions explicitly state to include all unmarried children under 21 (or age of majority in their location of domicile).

 

That said, the CO should know about the children already from the I-129F so that should be factored into their public charge decision already..

I had spoken to an attorney and I was told if I do not put them down on my income tax returns that I do not have to put them down on the Affidavit of Support
