Hi all!

 

Just a quick one.... currently gathering all info I need as my k1 application has just been sent to the London embassy and is now ‘ready’ when I check the status. 

 

1) Do I submit the affidavit of support WITH the online visa application or can I submit them separately? (This is because my partner is currently in the uk with me and doesn’t fly back to the US until next week. He needs to help his family member with the forms to co-sponsor so I can’t submit that info yet).

 

which brings me to my next question.. 2) who can co-sponsor? I know from reading online the basic requirements but would it be possible for my partners father to co-sponsor even though I have never met him and he lives in another state from where we are moving? He works full time and would meet the income requirements. 

My partner has been studying in the uk for the past 2 years and therefore doesn’t meet the income requirements himself. 

 

3) Is there a specific order to do things in now. Like submit visa application, pay fees, submit affidavit, book medical..? I have done so much reading online but I’m still confused by the process lol. 

 

I hope that all makes sense.

  1. The I-134 is presented at the interview.
  2. Any USC or LPR domiciled int he US can be a sponsor. The CO makes the decision on who is actually acceptable as to how it relates to the ability to ensure he beneficairy will not become a public charge. London is generally quite lenient with the I-134, but I don't have specific information as it relates to co sponsor suitability if you don't actually know them well. People have been denied at other consulates in similar circumstances (reason being is they are not likely to actually support somebody they don't really know, if needed).
    1. NOTE: When it comes time to file for AOS in the US, you are not bound to use the same sponsor (or any at all). The I-134 is not enforceable so they are not legally on the hook for anybody yet. The I-864 (for AOS) is enforceable.
  3. Medical s before the interview and affidavit is at the interview. I'll defer to others for the rest as it is consulate specific.

Ok so I’m still slightly confused (sorry). I have the template saved on my computer for the I-864 but are you saying the one we need to fill out ready for my interview is I-134? And I don’t have to submit it online just take it with me to my interview? We do have a lawyer but she’s off for the next few weeks and I wanted to use this time to get as much done as possible without her. I don’t want to waste any time! 

I’m guessing this means that I can book my medical now/send off visa application/pay any fees. And then just get all the sponsor forms ready for the interview.

You are applying or a K-1 visa, right? Then you use the I-134. The I-864 is only for an immigrant (AOS within the US or immigrant visa abroad). The I-134 is for non-immigrant visas like a K-1.

 

The I-134 (and supporting documentation) is provided at the interview. It is not submitted anywhere beforehand, and there's nowhere to submit it to.

Yes sorry, I should have been more clear. I’m applying for the k1 fiancé visa :) 

I think I’ve done too much reading and got mixed up with some of the info I’ve found.
