My son birthday is March 5th,1996.My PD for F2A is Nov 22th,2016.The case was approved at Aril 5th,2018.Both my son and I had the interview at March 13th,2019 Guangzhou,china.My case was approved but my son was rejected for he was aged out into the F2b category.Could we ask immigrat office to reconsider?If we still want to immigrat and sumbit F2B visa application,Can we request the priority date recapture of the F2A I-130 when filing the new I-130.?

Your son was only a few months short of turning 21 when the initial petition was filed, you must have known it was a high probability he was going to age out? Unfortunately he did, even though it was only by a few weeks on CSPA age (I see he was current in February). The CSPA age must strictly be under 21 for the child to not age out, so he was correctly moved to F2B.

I don’t think you file a new one, from what I understand the petition is automatically moved to F2B with retention of original PD. Maybe someone else can confirm this?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
