so i dont know where to post this but i received my 10 year green card and i have like 6-7 years i think left on it me and my husband are having serious problems after 6 years and honestly i dont know if i want to return and just go back to my home country of the U.K im just wondering what happens with my status and my green card and me visiting the U.S in the future if we did give up and i left ?

If you leave US permanently then I suggest contacting USCIS and officially giving away your green card. That way you don't have to deal with other issues and you can always come back visiting US with your ESTA (I assume you qualify) or B2 visa.

You can also get your US citizenship and then come and go whenever you wish. Sometimes people find they want to return to the US to live so it gives your the option with no more immigration to go through. You would have to file a US tax return every year, but it wouldn't be costing you any tax money. It would be mostly informational.  

 

You are already eligible now if you remain married to hub (3 yr rule). If divorced, eligible in Nov 2020 (5 yr rule).

We have been married 5 years going on 6 and I think I've been out of the country so long that I need to keep my british citizenship so I can earn money once I return it's just such a huge thing to deal with cant believe this is it but life happens I guess people grow apart just more worried about getting home and what to do right now but dont want to mess up future chances if I did want to come back

You never lose British citizenship.  I am a citizen of the U.K. by birth and a naturalized American citizen who started out as a K1 visa holder. I have two passports and can live in either country at any time for as long as I want without any immigration process or ESTA. I can work in either country without any new authorization application.

 

Look at your greencard. It says on there "Resident since _______".

You are eligible to become a US citizen 3 years from that date if you are married to your US spouse from the time you got your first greencard. Looking at your posted timeline, you got AOS approval Nov 2015. You have been eligible to be a USC since Nov 2018. You could apply today. You have to submit some documentation showing you are married and have Joint things...like removing conditions documentation but not nearly so much. And it doesn't take as long for the application to process.

 

Anybody with a greencard is eligible for citizenship 5 years from their greencard date, whether they stay married to that original USC spouse or not. It's just a perk to be eligible in three years if you got your greencard based on marriage to a USC and stay married.

My ex-husband (also a UK citizen -- I am the US citizen) and I were married for about 6 years before he wanted to end it. We had our reasons (which were really messy) for splitting but he ended up deciding to stay and get citizenship after our divorce started because he had built up a business here. He filed under the 5 year rule and had no problem. He told me that they never even asked him in the interview about why we got divorced.

Keep in mind if you become a US citizen and then move to the UK, you are still required to pay US taxes to the IRS based on your world-wide income.  There are tax treaties and a foreign income exclusion that help reduce the tax burden depending on your income level, so read up on all of that to know the tax implications of becoming a US citizen and then living somewhere outside the US.

It would be highly unlikely that a single working woman in the UK would have a salary around £83,000/yr so I doubt the OP would ever owe the US any tax. And there's the foreign tax credit that would offset US taxes if she becomes CEO of some company and pays 40% in UK income tax.
