Based on the last para...

Adjustment applications and ancillary benefits – The new application fee for an I-485 is a package fee that includes associated EAD and advance parole applications. Thus, if you file an I-485 with the fee listed above, while you will still need to submit applications for an EAD and advance parole, you will not need to pay a separate fee so long as your adjustment application is pending. However, if you filed your I-485 before this fee change, to apply for or renew your EAD or advance parole, you must file a new application with the new fee for those applications.

What do they mean when they say as long as your adjustment application is pending?

I am confused :help:

If you file for your I-485 it is then pending you will pay the $1010. You can then file for the EAD and Advance Parole with no extra fee as long as the I-485 is in progress.

If you have already filed your I-485 before 30 July and will only be filing for the EAD or / and Advance Parole after 30 July then the new fees apply to you which is like over $300 each...

Another quick (probably stupid) question - Why would I need to make an application for Advance Parole?

It is an Application for Travel Document / Advance Parole - Not 100% sure but think this lets you in and out of the country...

Hmm... I thought a K3 visa is valid for 2 years and one can be in and out of the country during that time without any other requirement. But I could be mistaken. Can any of our veteran VJ members please shed some light?

Yes, a K3 visa is for multiple entry for two years from initial entry. The reason advanced parole is included in the same fee is that K1 visa holders would need it, as would say a person who arrived legally on any non-immigrant visa, subsequently married a USC and filed for AOS. EAD is included because it can be granted separately and before the green card for multiple AOS scenarios as well.

Under what circumstances would someone filing for CR/IR-1 NOT need to pay I-864 fee? From the info above it appears this is a possibility...

You seem to have interpreted that there is no I-129F fee for K3 but the statement refers to citizens seeking immigrant "status" for their alien spouses. Did you see some further clarification?

I see the chart pretty well clears this up. It shows K3 petitions have no I-129F fee and refers to "status" but no mention is made of K3 under the I-485. I guess I'll be filing in late July and hoping to get caught up in the delay caused by the rush. I don't want my wife's AOS approved until after December 1, 2007. The increase is double for me because there's an 18 year old step-daughter's fees as well.

You go it. K3 129D = $0 so K3 is cheaper than K1 now.

EAD is included because it can be granted separately and before the green card for multiple AOS scenarios as well.

One more thing... You can and might need to file for advanced parole even if you are going the K-3 route. (check the K3 flow chart in the guides). My undesrtanding is that once you file for AOS (I485), you disable the K3 visa so no more multiple entry so if you need to travel, you need the parole and if you need to work you need the EAD. All this is for the temp period between AOS filing and approval.

I'm brand new to all of this and this site.. still learning the meaning of abbreviations used also (any abbreviation list I can refer to?) Anyway, I've sent in I-130, 3 wks & still waiting for NOA. I'm expecting it anyday now. I plan to send in I-129f next. I'm not sure if I should wait until after July 30th or not (because I think its saying it will be "free")? I see there are other fees due later. I'm not 100% clear as to what other fees/forms need to be submitted or when. Once my husband gets interview in Jordan, what $ is due and for what? After this and he is with me in America, what more is to be paid and what for? I thought it was when he is in USA we will file to adjust status to permanent. Please tell me what options I have? File I-129f asap or wait? I really just want to have my husband with me as quickly as possible.

Maybe this has been already addressed.. but again.. I'm new here and my brain is feeling a bit squeezed right now. But it sure feels better than before I found this site.

One more thing... You can and might need to file for advanced parole even if you are going the K-3 route. (check the K3 flow chart in the guides). No. Filing for AOS with the USCIS has absolutely nothing to do with the terms of the visa in your passport, issued by DOS. Just what did you read in teh K3 flow chart that gave you that errant impression?

Apply for Adjustment of Status (AOS). You should file before the K-3 Visa expires. If you have not filed for AOS and your K-3 expires, you will be considered out-of-status until you file. I guess you need it if the visa expires...

Exactly! If the visa expires. Beginning the AOS process doesn't invalidate your visa. The calendar does. :yes:

First, you have already sent your I-130 in before July 30, 2007, so you still need to submit $170 for I-129F petition. The sooner you send in the I-129f the better for getting your spouse here quicker. If you file a I-130 after July 30, 2007 you pay for the I-129F petiton when filing the I-130 ($355). Currently, you send in $190 for the I-130 and $170 for the I-129F for a total of ($360). There is only $5 difference.

What you need to pay depends upon which route you follow and what the charges are for the medical physical and Embassy charges in Jordan. Charges for documents will vary also.

The guides are full of information on the later fees. I suggest you study them carefully. As for filing the I-129F now or later, you make the value judgment between paying the fee now and extending your time apart for several weeks to save the fee. You'll pay the later fees regardless. If you're going to wait, then since a few weeks isn't all that important to you, it will be far less expensive to just get the CR1 visa that would result if you don't file the I-129F for K3 at all. Chances are you would wait 6 to 8 weeks, which isn't much more than you save by filing for K3 to begin with.

I'm brand new to all of this and this site.. still learning the meaning of abbreviations used also (any abbreviation list I can refer to?) Anyway, I've sent in I-130, 3 wks & still waiting for NOA. I'm expecting it anyday now. I plan to send in I-129f next. I'm not sure if I should wait until after July 30th or not (because I think its saying it will be "free")? I see there are other fees due later. I'm not 100% clear as to what other fees/forms need to be submitted or when. Once my husband gets interview in Jordan, what $ is due and for what? After this and he is with me in America, what more is to be paid and what for? I thought it was when he is in USA we will file to adjust status to permanent. Please tell me what options I have? File I-129f asap or wait? I really just want to have my husband with me as quickly as possible.

Maybe this has been already addressed.. but again.. I'm new here and my brain is feeling a bit squeezed right now. But it sure feels better than before I found this site.

The guides are full of information on the later fees. I suggest you study them carefully. As for filing the I-129F now or later, you make the value judgment between paying the fee now and extending your time apart for several weeks to save the fee. You'll pay the later fees regardless. If you're going to wait, then since a few weeks isn't all that important to you, it will be far less expensive to just get the CR1 visa that would result if you don't file the I-129F for K3 at all. Chances are you would wait 6 to 8 weeks, which isn't much more than you save by filing for K3 to begin with.

Thank u so much.. a day without my husband feels like a month..We're really feeling a bit lost without eachother. I will continue with my original plan of sending out the I-129F now (that is if I get the NOA letter for the I-130 sent 3 weeks ago.. recording says could take 4 wks.. :( ) and pay the current fee.

So is this correct?.. We would need to pay for I-485, I-765, and I-131 when my husband is here in U.S. or will the new I-485 fee $1010. include pymt for I-765 and I-131? :o Ummm.. am I getting it or am I still out in left field? Am I missing anything?

Oh,oh,oh...What fees would we pay at 1st interview in Jordan? (sorry I looked at chart and still brains cramping a little)
