Traveling on a visitor visa while an immigrant visa is pending

Hi All,

I am currently in the process (NVC) of completing my step-son's immigrant visa. He already has a visitors visa for which he has visited the US prior to beginning the immigrant process. Is he able to come for a vacation to the USA (1-2 weeks) and return to his home country before completing the immigration process?

He can certainly board the plane and request admission as a visitor. Whether he will be given permission to enter is up to the CBP officer on the day. No entrance into the country is ever guaranteed except for USCs.

 

That said, many of us have visited without incident whilst our immigration case was in progress.
