Hey guys, just looking for some guidance really. What are the process for direct filing in London? What did some of you do? My husband have been here since September and we are thinking of starting the process either end of May or June. What do we need in terms financial requirements? I believe my husband was way off meeting the financial requirement as he had to relocate to the UK so I know that we will need a co sponsor. Also, can my husband stay with us during the process or does he have to leave ahead of us and collect pay stubs if so how many do we need?

Best not to wait.   All foreign USCIS offices are slated for closing.   London hasn't been announced yet, but it is coming

Financial requirements are shown in I-864P.   Getting a sponsor is pretty typical in a DCF.   That is not needed in the interview part of the process.

 

He han stay in the UK during the whole process if he has access to whatever records he needs.

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thank you. So really he doesn’t need to have a few pay stubs? Is an offer letter of employment enough?

Your husband will need US income of at least $21,137, provided your household size is just you two.

 

With regards to proving that, the I-864 instructions does not specifically require evidence but it would be beneficial to have something handy:

 

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income.

Thanks for your response. So since most of last year my husband barely worked in the US as he was preparing to relocate to the UK - a joint sponsor is our only option. I have read somewhere that the joint sponsor must meet the minimum financial requirement is that true?

Correct, the joint sponsor's income will need to meet the same income requirements (125% of the poverty level guidelines) for their household size (don't forget to add 1 for your husband).

So what would happen if both don’t meet the financial requirements? I would think as co sponsor it tops up the short fall of the sponsor? I’m now worried that my mother in law does not meet the financial requirements and she’s the only one we can think of ☹️

The petition would be rejected for not meeting the financial requirements. The financial requirements are independent and cannot be combined. FYI, a joint sponsor does not need to be related to you.

 

I believe it is common for people to submit their petition and then for the US citizen to leave the UK in order to fulfill the financial requirement. That would be your only option if you cannot find a joint sponsor.

Right but there’s 3 of us that he needs to petition and he mainly works in the warehouse. Not quite sure how he would meet that

Obviously each persons situation is different, the London Consulate seems fairly flexible over intent to establish domicile but some need to go back early and get a job.
