Hello everyone!. I'm a newbie (petitioner) getting ready to file for K-1 visa for my fiance in the Philippines. I just have a few concerns which I'm hoping any of you could help me with.

 

1. Affidavit of support: Now, I know this is for later on for the interview but it's my biggest concern. I got hired Nov 2018 after being a full time student (unemployed) for 2 years before that. My last 3 tax returns are 2015, 2016, 2018. My income from those 3 tax returns don't meet the requirement for K-1 visa. However, my income right now is above the requirement, which I can prove with pay stubs and a statement from my employer. I can also provide a statement from an officer from my bank. I'm just concerned if those are enough to prove to the CO about financial stability. I've read some people hear say that some CO look for tax returns. My sister is willing to co-sponsor but I hear it's case by case in the Philippines. Thoughts about concern #1?

 

2. My fiance was a crew member on a cruise ship for many years until very recently.  The ship has ports in the US so he had a crew visa or transit visa or a combination of both. He never got I-94, instead he received I-95 whenever the ship arrived at a US port. For question 37 on I-129F, I will answer yes, he's been in the US before but I will leave 38a-h blank since he isn't currently in the US. My concern is whether to provide a copy of his most recent I-95 when I file the I-129F. Thoughts about concern #2?

 

3. Employment: Like I said at #1, I was unemployed (student) for 2 years before getting employed late last year. For the employment section, should I include that I was a student to explain the gap between the two employments? Thoughts about concern #3?

 

4. Citizenship: I'm a naturalized US citizen through my parents. I was still a minor when they were naturalized. I don't have a certificate of naturalization or certificate of citizenship under my own name. I have my US passport. So for the question regarding citizenship, do I check 40b naturalization or 40c US citizen parents? I'm leaning more towards US citizen parents since I wasn't naturalized myself. Also, when I make a copy of my passport for the I-129F, should I make a copy of all the pages?

 

5. Beneficiary's address abroad: He lives in the Philippines, so do I put his address here again even though it already asked for beneficiary's mailing address before?

 

7. Questions that don't apply to me: Leave blank or put N/A?
