Child Custody Issue

So my fiancé has a two year old who I am applying for as well. It is my understanding in the Dominican Republic they give both parents joint custody. However, my fiancé’s baby father has left the country and now lives abroad. How does my fiancé get an order giving her sole custody in the DR so we can file that information with our petition?

any help would be great!

That isn't really entirely an immigration issue.  Your fiancé should be able to find out locally in the DR how to go about seeking sole custody in the family courts.

For the K-2, you would include whatever court order or documentation she receives.

I know it not an immigration issue but just hoping someone had some experience with this dealing with Dominican family court system

Hi Thomas,

My wife experienced the same and went through the courts in the DR. We can chat offline (PM) because, like said, this forum specializes in immigration issues and this is more of a civil issue,

But the process was pretty straight forward. Your fiancé goes to court in the DR  and explain her case and the judge will make a ruling. Other than it taking a little time and money, not much more than that.

We applied for my step daughter as well.. and her mother lives in Trinidad since she was 2 she is now 10.  So far they didn’t ask for nothing yet but her case is now at NVC. We are waiting to complete it cause my husband wants to come here first and start working so he can help pay for her. So I’ll let you know how that goes when we continue her process

To those who are and will post in this thread telling the  OP his question not being an immigration issue. I can assure you that it is indeed an immigration issue. So please if you cannot help the OP with what the OP's fiancee needs to be able to have her child Immigrate do not post.
