He has a job and tons of responsibilities that won't allow him to travel.

He isn't a high income person and travels when he can. 

As I said before, don't be so hard on me.

If I get rejected, we will try again with a CR1. We are not totally married, so I can't apply for that now and we already paid for the K1, so, I can only finish that process and hope for the best.

There isn't much I can do at this point.

So how are you answering if the CO asks if you are married or had a party or why your parents can't attend and your not bothered by it?

 

"It's been 5 years and we can only see each other twice a year."  That's a long time to be engaged.

We didn't sign anything when we got married. Maybe it wasn't even recognized by the catholic church. They gave us a piece of paper but it doesn't have any kind of signatures.

He is a Christian and I'm a Catholic

And of course it bothers me that my family won't be in the US for my legal ceremony... I wanted my dad to approve my marriage but it wasn't the case. He doesn't want anything to do with the USA.

If the CO asks, I will say we did have a non legally binding ceremony and party. I won't lie.

It's not a mock wedding, church and state are completely separated here. I got special permission on the legal part because I applied for it and cleared I would get legally married in the US. It took a lot of paperwork in my church too.

Don't about talk things you don't know about.

Look into the canonical rights of the catholic church and you will see it is possible to do a few things.

Good plan.  There are many cases here on VJ of such lies that have later come back to halt later processes in immigration, such as AOS/citizenship.

I am pretty sure that was not a mock wedding. Probably full blown bride in white/off white, everybody dressed up etc. In the eye of the catholic church they are married for sure.

At this point given how close you are, you might as well go ahead with the K-1.  Just don't lie during your interview, and you'll be fine.  If they decide you're too married, you'll have your answer then, but it's not like they'll ban you from a CR-1 later on.  You are indeed not yet legally married, which is what the US government cares about for the CR-1.

I just came here for advice, not to be judged.

I am not legally married, just religiously.

I could only have a catholic ceremony because I asked for a permit to do so, I presented evidence to my church and promised to get legally married after it.

In Mexico, a religious ceremony of any kind, doesn't have a legal value and my civil status is single. He can't make decisions about my health or get benefits if I die, only my parents.

I am not planning on lying to the CO, I am getting a certificate expedited by the government that says I'm legally single, I have his divorce decree and the intent to marry letter signed by both of us. If that's enough to get me the K1 Visa, will be perfect. If my religious wedding is an impediment, we will get legally married and go for a CR1.

I declare this topic closed and won't look into the answers anymore.

I appreciate your advice and will discharge the judgement.

Every family situation is complicated.

Usually both families want to be at the wedding.

Everybody is tired of waiting.

These are no reasons to do something that will cause a longer wait nor to have wasted the money spent to far on the process.

 

No certificate proves you are not married or that you did not ever marry.

The mere attempt to try to prove that you are single would generally make one wonder why they are trying to prove it. That's not something a single person normally does. A rational person would suspect that there is a reason for believing otherwise.

 

Yes it is possible to be denied a K-1 visa for being "too married". The burden is always on the applicant to prove their case.

It is possible to be unable to prove you are free to marry (for a K-1), yet not being able to prove you are married (for a CR-1).

 

Keep in mind that even if the visa is issued, CBP can still deny entry if they suspect that the visa was issued incorrectly (i.e. that you may not be free to marry).

No one is judging you, not one single person. Everyone is being truthful and you are being naive, rude and defensive. You are legally married, whether you want to admit it or not. The Catholic church does not do weddings to appease families, they do weddings to marry people. You're married. 

 

This is an immigration site where people come to for advice, you were given truthful answers and you accused people of being "too judgemental and hard on you". If you didn't want truthful answers, you shouldn't have asked a question. Just because you don't like the answers you've been given does not make people judgemental, it makes them truthful.
