Hi,

 

My wife is US citizen and we are expecting a baby in October 2019. We can not obtain CRBA for our expected new born as my wife doesn't fill the requirement for physical presence. We are planning to deliver our baby in Pakistan due to wife medical condition. Meanwhile, I am also waiting for interview for IR-1 as Documentation of my case is completed recently. 

 

Now I need help for how can we get the travelling document/passport for our new born as we want to travel to USA as soon as our baby is born. I can think of following options but need your help to validate them:

1. Apply new I-130 for our new born (but it will take again a year to approve). Another question is that if I apply I130 for my new born, will baby get the citizenship automatically on arrival or she will get Green Card?

2. Can we add our new born baby into my already approved I130? If yes, what will be the steps ?

1) yes petition the child.  If the child is due soon you may want to slow down your IR1 processing (aka stop processing) until he child can catch up.  However since many Pakistanis end up in AP I'm not sure it makes a difference. The child will be a USC upon arrival not an LPR.
