Clarification please

Correct me if I'm wrong. My fiance was told told she needed to come back for a psych evaluation in a couple weeks. If she has her interview prior to getting the results of that evaluation then as I understand it she should still go to the interview and assuming she was granted a visa then the embassy would just tell her she's approved but would hold off issuing the visa until they received her results from the evaluation. Is that correct?

 

She already knows that her xray and other tests from the medical exam were negative because she asked about the results even though they would not give them to her to take with her. From what I've read on this forum the pysch evaluation really isn't anything to worry about, correct?

Yes that is true for the interview, but if the results are such during the adjudication process the CO reviews the medical results and at there prerogative they could deny the visa even after expressing to your fiancé that she had passed.

 

Your chances are good as we have over the years seen many in her same situation and they were able to receive their visa.

You can not attend the interview if the medical is not completed, you will be turned away and told to reschedule.     If you have not received the vaccinations and given the sealed medical file to hand carry to the interview ... then you have not completed the medical.

 

Psych evals are normally very simple and nothing to worry about.

Now I'm confused because I read an old post on here from awhile ago that said that they will give a form that will state that the visa would be held pending the results of the medical once the embassy gets the results.  I'm trying to find that thread now to show you.

 

And I've heard that people do the interview first before doing their medical exam.

Old posts are just that  ... old information.  Thus bad information.    Don't bother finding the old post .. it is useless.      Same as posts stating to complete a DS-156 & 157   obsolete information.

 

Medical not completed, you will not be allowed to attend the interview.     

 

Of course you can do as you please and run with the old info... for sure I am not trying to tell you want you can and can't do.

Why not bring everything to the interview .. then not worry about a 221g  ;)

I called the embassy and explained the situation and in the end it was suggested to me to reschedule to be safe. They did tell me it was at the discretion of the interviewer whether they would perform the interview without the medical results and could issue the 221g after a possible interview. 

 

On the confirmation page after scheduling an interview it states the following:

If you are missing any of the required documents listed in the aforementioned “Immigrant and K Visa Applicant Appointment Package/Instructions” on the day of your interview, a consular officer may refuse your case under Section 221(g) of the U.S. Immigration and Nationality Act.  While a 221(g) refusal can be overcome once you provide the missing documentation and a consular officer has reviewed it, having all of the required documents on the day of the interview may prevent unnecessary delays in processing your case.

 

This is consistent with what the embassy told me.

 

We chose to reschedule to be safe but I'm passing this information on to anyone else that reads this thread. Thanks to everyone for your replies.

Yup aware of what says on the website and what the call center mimics,  but I have not bumped into any in this past year + that were allowed to attend their interview without the medical.  I have bumped into a fair number that were not allowed to attend their interview without the medical completed .. so I tend to pass that on ..  ;)
