Hello VJ!

 

Y'all have been the most helpful resource I have found for all the immigration process, so I come to you once more.

My GC expires on June 2nd. I have just received my divorce decree signed by the judge.

 

I have been gathering as much evidence as I could for the past few months, but my ex, while he is well-intentioned, tends to misplace things, delete important e-mails, etc.

 

So here is what I have:

- Divorce decree

- Copy of GC

- Letter explaining our relationship and why it failed.

- Proof of living together while we were married (2 joint leases)

- All our joint bank account history

- Copies of 2016 & 2017 tax returns, filed jointly as married

- Copy of 2018 tax return, filed separately as married

- Copy of vision insurance we shared 

- Copy of auto loan that he co-signed

- Copy of health insurance card with both our names on it.

 

I also have some pictures and FB posts we tagged each other on during our first married year,  (it got really rough after that and we did not interact online together as much, or get in pictures together, unless we were with other people).

I have friends who have epressed they would be willing to write a sworn affidavit, but I heard those really on`t have that much weight anyway.

 

I do not have any proof of going to counseling, since his refusal to do so is what prompted the divorce. 

 

I have to send my things by the end of next week if I want it to be there in time. 

Any help is appreciated.

Sounds like you have everything you are going to get.  If this a removal of conditions submission you need to move forward with it, because until you get that NOA1 back, after your GC expires you are in jeopardy. 

 

If it is for renewing a 10 year green card, just submit it anyway.  You’ve had 12 years of marriage.  It will be ok.

If that all you have then that all you can submit.  You may also include in case you have:

- Pictures that you guys visited each other’s parents/relatives.

- Flight tickets for vacations 

- Gift receipts you purchased

 

They may add some weight into your petition.

If you can get Call data prior to your marriage from your phone provider. List of text messages and phone calls made between you and your ex's phone-numbers could also be part of evidence that shows relationship being genuine upon entering marriage.

When you don't file jointly, you raise a presumption that your marriage was not legit and only happened to get you a green card (even though that wasn't your intention). To rebut that presumption, you should carefully present evidence in 2 areas:

 

Evidence of what happened before or at the start of the marriage, including evidence of:

- How you met

- How you stayed in touch

- The wedding

 

Evidence of what happened since marriage to date, including evidence of:

- Joint residence

- Joint finances

- Joint ownership of property

- Shared experiences (trips, events, children)

- Planning for the future together

 

The specific documents I'll leave to you (you already have a good number!) but just keep the above in mind and you'll be fine. You can even structure your cover letter to reflect these areas. Good luck!
