hello everyone

I got a question about my immigration lawyer who was not any good I paid him half the price he asked for, then after 2 months I received the work permit but I didn't receive the travel document. I asked him why he didn't he said he doesn't recommend it and then went to ask me more money to apply for it. I so do wanna travel,  now I can't because of this incompetent lawyer, My question is if I stopped paying him monthly like how we agreed on would he withhold my card until I pay him or something! because all documents somehow go to him even though I put my old address there.

one more question is how can I change the address to not go to the lawyer

You need to understand the contract you signed with him as his client. If you would like to fire him, tell him that you would like to fire him (you can use different word then “fire”) and request for all docs that USCIS sent him and the ones that you submitted to him and discussed about the remained fee. Also contact USCIS regarding the change of lawyer.

 

As he is your lawyer and you might give USCIS the permission to contact him instead of you, if so, it is very normal as they sent docs to him instead of sending the docs to you.

 

You can prevent him from accessing your credit card/debit fund by letting your credit/bank institution(s) know. Just do not do it without checking your contract and discussing with him. 

 

You have the right to fire him anytime and request all docs from his rendered services. You should not pay him for services he has not rendered, however, this can be tricky.

Non-payment would be a civil matter to be addressed based upon the terms of the agreement.

It would be unlawful and unethical for him to withhold materials he does not own. That said, that's also a civil matter if he chose to do so.

He could also just send it back to USCIS stating he doesn't represent you anymore. Either way, you wouldn't have the card so it's not exactly a good experience and you would need to go through USCIS to get it or have a replacement mailed.

I would suggest that you review the terms of your agreement with the lawyer, specifically both parties rights and responsibilities as it relates to termination of service.

I suggest you inform USCIS that you are withdrawing your legal representative. You will still need to resolve the matter of contract with your lawyer though, but that should cut him out from ability to influence your case with USCIS

In addition, you still might be able to file form I-131 for free for your travel authorization.
