Hello guys,

 

I came to USA September 2018 with K1 visa. And I got my green card on April 2019. I was thinking that the first GC will be only 2 years but it is for 10 year ..At the begining I thought they made their own decision but later on I learned that this is mistake after little searc. I called USCIS and they gave me revice req ID # and told me that I will receive an e-mail between 2 - 4 weeks about it.

 

Probably they made wrong but how about if I just keep the card and apply for 10 year green card on the date which they gave me ( around 2021). does it effect my case ?or  do I have to definitely change the card with correct one ?

 

anyoone has experience with this issue ?

Yes! You absolutely need to have this corrected ASAP. 

USCIS made a mistake but it's your responsibility to correct it.

 

If you don't, your RoC in future will be rejected and there will be whole lotta more problems to deal with. You cannot "claim" to be permanent resident when you're only conditional resident. Fix this for your own good.

how about if I apply for 10 year green card on time (  before 90 days from 2 year)  with I-751 (not sure about form #) , do I still face with problems. or they just send me another 10 year GC?

Do NOT wait this long. You will need to send copy of your 2 year green card with RoC petition... And you don't have that.

 

Do you really want to risk USCIS revoking your LPR status? Just fix your green card now..

No I do not want this risk.. Thank you .

 

So should I wait their e-mail ( USCIS told me they gonna reply me in 2-4 weeks)  or Should I directly fill out I-90 form and post to them without waiting ?

 

And when they fix the card, issue date will be the  same ( 03/26/2019 ) or they will put new issue date so applying for 10 year will delay  for me ?

There have been cases on here where they didn't notice the error on the card. Filed for ROC and it was returned to them. The person in the mail room that looks it over will only see a 10yr card and send the package back with a note saying you do not need to file. They will not see that the card was issued in error and still process the case. I bet they would still take your money too. 

 

The issue date should be the original date.

So does it mean in that case RoC is not needed and just apply for N-400 in a year?

No. It is needed but if the green card isn't corrected ROC gets rejected. Then you'll have problems with N400. 

 

I suggest to get a stamp in the passport. File I-90 to correct the green card. It shouldn't cost anything since it's USCIS error.

Oh no, ROC  is a must. Without it there is no status and can be deported.  One cannot get citizenship when not a permanent resident.

To be fair, even a person with a conditional greencard is a permanent resident. Other than that, the above posters are correct, definitely get that issue fixed asap.

Hello Guys,

 

I will definitely fix thiis situation.. Im following it..and will let you guys know.

 

So this week I called USCIS and let them know that my green card is for 10 years which is wrong because it suppose to be 2 year. An they told me that wait our e-mail and today I got e-mail from US department homeland security local office ..

 

''The status of this service request is:

On 5/15/2019, you or your representative contacted U.S. Citizenship and Immigration Services (USCIS) about your I485 because you believe your Permanent Resident Card contains incorrect information. 

Your case has been brought to the attention of a Supervisor and we are still reviewing the card information. We will mail you a notice when we make a decision.''

so they mail me about the situation.. They basically wrote '' we checked your PRC (Perminant Resident Card) and you have to fiil out I-90 form .ext ... '' and they gave me a linh

uscis.gov/efiling

so I filled out the form online and attached related documents which are my PRC card and the letter they sent me and offical proof of my name and last name Date of birth  (passport ).

 

So I kept my current card with me ...

 

Im following the case online and they say '' we sent you amail ,follow the instruction on it'' now Im waiting another letter from them..

 

 

I will go out of USA with my current PRC ( for 10 years as mistake), does it make problem ?

The big if in this whole mess is, If USCIS has invalidated your 10-yr GC and processing a new corrected 2-yr conditional GC and you are out of the the country with an invalidated card, that could be bad news. It would be like playing musical chairs game, everything is fine until the music stops and you are left standing (without a valid GC) out of the country.  I would do one thing at a time, the first thing being getting the correct conditional 2-hr GC in your possession.

 

Good luck on your immigrant journey.

You are right, but I think they would warn me if they cancelled my current card. And I also keep the letter which shows they approved my GC ... But yea still waiting another mail from them. it should explain process clearly . Maybe as you tell me , they will say , We cancelled your current card , go local Immigration office and get stamp on your passport until you receive your new card..

Im gonna wait...
