The decision is made from the interview and what's on the application...as mentioned, CO may not even look at any additional documents presented.  This is normally because documents brought to the interview cannot be authenticated on-the-spot by a CO (for example, fake/forged documents have been given as "evidence" before in these interviews--some VJ members have in the past even admitted in various threads to presenting fraudulent documents).

 

You also said she has no job or home ownership---presumably not much in assets---so even if she DID bring documents, not sure what else you'd have in mind as to any home country ties for her?  Financials?

 

Does she has any prior travel history?  Sometimes that can help...

:) OP may think become USC (compared to GC) status changes will have more positive impact to the outcome,  fair-enough but unfortunately, same answer.

Edit: one could argue USC status lessens b2 odds due to aos risk

Unless I read it wrong, I assume that what OP is saying.  Of course, many know it has zero difference.

 

Anyway, for 2 months and his wife has not applied, I am not sure it is considered a real medical emergency situation at all.

Don't know if the foreign spouse's relationship with the FIL is relevant to the discussion---it's possible the spouse wants to be present to support her husband if circumstances seem dire/the USC spouse wants his wife at his side during this time.  She also wouldn't be the first foreign bride to be married without physically meeting the inlaws first, if that's the case.

 

Whatever the reasons, wife is certainly eligible to apply for a tourist visa.  Getting approved may be a different matter but we can't assume too much with limited information, or any limited info regarding any medical circumstances that may or may not be at play.

Right, of course, embassies are FAR more likely to grant "family emergency" visas for inlaws than immediate family. Silly me, I really should think things through properly before I respond.

 

An inlaw as reason (who may or may not have been met), no property, no job, a pending I130, ... what could possibly go wrong in a B interview?

 

...not sure there is anything else to be said that hasn't been said already in this thread.

My assumption was India, Pakistan or Bangladesh would be a back up, but clearly the OP is not going to say.

 

Begs the question why it is such a secret, but not that uncommon, the old VJ adage to get good good answers you need to give good information comes to mind.

Unless there is "potential" fraud and willful misrepresentation in the OP and his wife's current strategy to secure a tourist visa,  best option: pay the fee and apply.  And if medical emergency situation is really valid and his father really wants to meet his daughter-in-law , there is no reason to delay (it has been 2 months).  I will ignore the possibility that OP/his wife does not want to risk $160.00, assuming OP/his wife really wants to do this for his father's sake.

Not true. I have seen  ppl get visas for in laws, grand daughter in hospital. Trying to see for those with already i130 filed

I don't think you get it. But to really get it let them apply for the tourist visa and find out. They may or may not get approved.
