as anyone applied for wife visit visa while they had filed for i130 (still pending) on basis of family emergency (father in law in hospital)

 

-filed i130 when I was PR over 1 yr ago & now USC

-already sent CSC update

- have invitation letter & medical report

The CO will be  more concerned about the reasons she will return after visiting, rather than the reasons for coming to the US.  With the i-130 filed, it can be more difficult to present compelling reasons and stronger ties to the home country---but not impossible...is she working/own a home, etc.?

Did we not cover this in your previous thread a mere two months ago?  Responses won't change. She can certainly apply. What country?

Why would she return to US, when her i130 is for to goto US. The way I see it, she will enter US regardless. The fear of those not returning is for ppl entering US with no other way. She already has a way to enter. My reasoning is that it’s family emergency. I won’t mind, even if visa is for 1 month. There is no way anyone overstay to screw their i130 in process. She will certainly return to be interviewed at embassy. Plus it’s a women, unlike men who may enter & try to find job in US & not return

Not true. I have seen  ppl get visas for in laws, grand daughter in hospital. Trying to see for those with already i130 filed

The question is "why would she return to the home country"---not how she would she return to the US later on if spouse visa is approved ...with a US spouse, and a pending i-130 her ties are stronger to the US.  

 

Some people (mistakenly) think they can enter the US to "wait out" the processing time for their visa---her job will be to convince the CO this is not her intention, and again has compelling ties to return to her home country.  With no job, may be added difficulty, may not be---all depends on the CO. 

 

People overstaying and screwing up their i-130 in process happens more often than you may think.  And women get denied all the time too, otherwise would be discrimination based purely on sex.

 

An added factor to consider is what embassy your fiancee is going through----some are harder than others when it comes to approving tourist visas.  

 

All she can do is try and hope for the best.  Again, good luck to her.

No, it IS true. You may have seen those people get visas, but we HAVE seen visas denied for parents and children.

 

anyway, you seem to have a counter argument for every potential issue someone raises here so you may as well go ahead and apply. What’s the worst that can happen, you lose $160?

You can take bank statements, employment verification letter, docs for properties that you own, etc.  However, the interviewer has total right to determine if she/he wants to read them.  Do not feel bad if interview won't read them as it happens most of the time.

 

For a tourist visa, very rare case that outcome can be 100% sure - just pay $160 fee then apply and see the result.

If she wants a visitor visa she applies for one and sees, quite what other response you expect is a mystery.
