I am just about to start the CR-1 process to petition for my Canadian husband. We just got married and I would like to change my name. Will this delay the application? Should I wait until he has his visa?

 

Also, I’m about to move to a new apartment (likely after I submit the I-130), will this cause issues?

 

Next question, sorry, his best friend is getting married in Vegas this October. Will he be able to attend that wedding if we’re waiting on the visa process? I read about a tourist visa being a possibility. 

 

Finally, is it worth us applying for the K-3/K-4 visa in the meantime?

 

Thanks for any insight! We have been long distance for 3.5yrs. We just want to live together already!

1. No issue.

 

2. No issue. Just notify USCIS your address change and also make sure that you use E-Notification Form G-1145 so you can receive text/email notification when there is status change. 

 

3. As long as he can get a tourist visa, it should not be a problem. Note: It may be harder to get a tourist visa when there is application pending, however, many still can get it.

 

4. No. I do not know K-3/K-4 process well but it is well-known that K-1 is dead and there is probably 0 gets approved this 2019.

1) not an issue, change it whenever you want. 

 

2)just update USCIS whenever you move and sign up for email/text updates on the website

 

3)it's allowed and he doesn't need a visa obviously. Just bring proof of ties he will return and have a happy time. 

 

4)no k3 is obsolete.

Filing a petition does not cancel his Canadian visitor privilege.  Canadians don't need visas to VISIT the US.

He is Canadian, I was just confused as I had seen on other posts that people needed to apply for a tourist visa. But on the other ones I read they didn’t say what the nationality was. So I was confused.

 

When he travels to the States, does he need to disclose right away that he is applying for a visa? Like, when they ask what he’s doing in America, should he say “I’m applying for a visa but I’m just here for a wedding this weekend”?

No. Only disclose when he is asked if he has any pending visa application.

Attending a friend's wedding sounds like the purpose of his visit.  Keep it simple and truthful.  He isn't applying for a visa, until your petition is approved and a visa application is available.  YOU are the one who DID something.  You filed a petition.  HE has done nothing about US immigration YET.

No he doesn't need to say anything.  He hasnt applied for a visa yet (which is the DS-260.)  He is going to a friends wedding and will be back on xx date.  Dont make this more complicated than it is.
