I orginally applied for the K1 visa with my fiancee's birth certificate information.  Her middle name is Margarita on her birth certificate and middle name on the passport is spelled Magarita.  When she applied for her passport the Government of Colombia knowingly put the wrong name and would not change it because it was also mispelled on her I.D.  The application is left USCIS, left NVC, and now at the Embassy.  It is time for me to fill the DS160 and I don't know what name to use.  I applied with the name on the birth certificate but the passport is different and required for the DS160.  Can anyone help me?

Margarita needs to get her national ID replaced to match the name on her birth certificate. Then she needs to get her passport replaced to match her national ID and birth cert.

 

Since she is still in Colombia, as much as this is a pain, it is much less painful to get this fixed now versus trying to fix it in the USA (in the event she does get the K-1 with the wrong name). During AOS in the USA, the name mismatch could cause a problem, and going back to Colombia before she gets an Advance Parole document will mean she has abandoned her application to immigrate. So you would then have to start all over again with a CR1. And in the event AOS is successful with the wrong name, agencies like the DMV and Social Security might not accept the mismatch. And then there is the N-400 and/or USA passport.

 

Just get it fixed.

Is there any other way?  It was said that a correction to the national I.D. could take up to 5 months. We are ready to interview as the docs are at the Embassy.  That would almost be starting the process all over. National I.D. and Passport shows Sandy Magarita.  Birth Certificate shows Sandy Margarita.  I originally applied to USCIS with Sandy Margarita.

Ask the embassy what you should do. The embassy can extend the validity of the NOA2 from USCIS. Or the embassy can issue her visa. But then I worry about problems with AOS.

 

If it is just 5 months (i.e. the embassy will extend the NOA2), then that would result in the lowest blood pressure. Otherwise, the next 4 years, now until her USA passport will be very stressful.

For the Middle Name?

 

My Ex's middle name was misspelled, Liligan vs Lilagan. no one even looked at it, she's already a USC so I guess we got lucky or it's not that big of a deal?

I would just use her Correct name going forward on everything.

Up to you what to do though.

Her correct name is that on her birth certificate.

 

My wife once got a hassle in the Netherlands arriving on a bus from Germany because her Schengen visa had one more letter than her passport on one of her names. The visa had the correct name. Her passport did not.

 

I told her after that, that we need to fix this before we file the I-129F, and we did.

Use the name in her passport for the Visa.

Although the process can take some time, have her do it before she leaves the country and she can always get a new passport at a colombian consulate in the future. Good luck

5 months? whem you go to the registraduria they do that right away.... what city in Colombia?

Hi. Yes we have corrected the name. We are waiting for the I.D. to return. It was corrected in Cartagena. We did not want the hassle later so it was better to go ahead and correct it now. I guess now we need to apply for another passport. It seems they would correct the mistake since they know they did it wrong but I guess it does not work like that in Colombia.
