Hi! We are just about ready to file our K1 and this site has helped us tremendously.

 

A couple of last questions! My fiance (Us Citizen/Petitioner) is moving from California to Idaho next month.. our paperwork is ready, but would you recommend filing in CA or ID?

 

Second question, I am a dual UK and Australian citizen and hold both passports. My Australian passport expires in August, which is after we have filed but I will have a new one issued shortly thereafter. Is there a way to update the information on the filed petition or can this be done at the interview? I'm just worried it will sit on a desk for months as they do and my passport info on the application would likely have expired by then.

you will updated the passport information on the DS 160 form and take both the old passport and the new passport to the interview.

dont file until you move. have seen too many issues caused from moving in the middle of the process.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Every petition is submitted to the same place regardless of where you live

Slow down.   They have not yet petitioned

ALL I-129F visa petitions are sent to same USCIS lockbox address, one is for US Postal Service (USPS) delivery and the other for courier services (UPS, FedEx, etc.) delivery : https://www.uscis.gov/forms/direct-filing-addresses-form-i-129f-petition-alien-fiancee

The reality is that the submitted I-129F visa petition will likely languish in a file box, in a large government warehouse somewhere until it is adjudicated. The beneficiary's passport is generally not required until the visa interview phase at the interviewing embassy/consulate. Please refer to VJ Guides for details: https://www.uscis.gov/forms/direct-filing-addresses-form-i-129f-petition-alien-fiancee . In the off-chance that you get an RFE along the way due to beneficiary passport expiration, send in the bio page of the old and new passports with an explanation letter in response. I would suggest that you take your current (likely expired by that time) passport and your new passport to the visa interview and explain their expiration and replacement.
