My co-sponsor started to work at his university in late august of 2003. His starting salary for the first year was around 56k. But being in late august of his first year, with most the year gone, I dont think he earned 29,000 which he would need to be a co-sponsor since he is married and had a baby last May. Is this going to be a problem? He just finished med school the very same summer. Coupled with my shaky work history, im concerned about all 3 years not being above the level. His wife was earning about 30,000 dollars in a teaching position while he was in med school but that wont matter right? since the couple cant fill out the form together. Thoughts anyone?

Have you checked in the Regional forums for specific info on the country your fiance will be interviewing through. That way you can find out what is required by that particular embassy. Have a look HERE

Sure. Can you cite where it states that all 3 past tax returns must meet the poverty level (for what year, btw?)?

Thanks Aussiewench.. I looked on the latin american board and couldnt find anything so i posted the question. but it doesnt seem to get near as much traffic as this board. We will go through the Consulate in Rio De Janeiro. So anyone who has been through this one, Id love to hear from you.

If your cosponsor is a US medical doctor, even though he just graduated from med school, I wouldn't worry about it. He'll be making probably a minimum of 80K/year to start depending on the area of the country. Also, for the K-1 I-134 you only need tax returns for one year prior. At least for the bangkok embassy this was the case.

12/15/2005 - Sent I-129F to Vermont Service Center

12/17/2005 - VSC receives I-129F via express courier (day 1)

12/23/2005 - VSC officially sends out NOA1 stating receipt

01/05/2006 - Called the National Service Center and got NOA1 receipt number.

01/10/2006 - NOA2 received via USCIS website and email. VSC is blazingly fast! (day 22!)

01/20/2006 - Receive NOA2 via snail mail in Thailand

01/26/2006 - Bangkok Embassy confirms our case is in their system (day 38)

01/30/2006 - Dropped off checklist and doc's with embassy

01/31/2006 - Received email from embassy confirming our interview date 3/20/06! Woohoo! (day 43)

02/08/2006 - Received police report and packet 4

03/01/2006 - Medical Exam completed

03/20/2006 - Interview! (day 91)- SUCCESS!

03/21/2006 - Picked up VISA!

04/04/2006 - Fly to USA together to get officially married in US and to start our life there together!

04/07/2006 - Arrived at JFK, C received temp EAD stamp. Drove to MD to live!

04/20/2006 - Applied for SS Card in maiden name, received it 3 days later

05/12/2006 - Officially married in the US! (2nd ceremony)

05/15/2006 - US Reception

05/16/2006 - Applied for new SS card with married name - Applied for EAD

06/01/2006 - Applied for AOS I-485

10/27/2006 - EAD Approved!

Im just concerned because it was said many times that some embassies require 3 years of tax returns. Im wondering if the one in rio de janeiro is one of them. thanks for all your help guys!

Have a look a the links I posted for Rio....it lists what is required and yes you require 3 years. Whether the prior two years need to meet the poverty guidelines though is another question and something you need to find out from others that have gone through their interviews already. I imagine they will look more at the current and future capacity then the past, but who knows.....check with others or even give the consulate a call or email to find out. In the I-134 pinned thread here on VJ in the Foreign Embassy Forum, it talks about doing a statement in the form of an affidavit in addition to the I-134. Perhaps that is something YOU can look at doing.

Id like to hear from anyone who has gone through the process where 3 years of income taxes were required, while not having all years above poverty level due to a new job or some other reason. Since his job is very steady and has potential to earn more in the future gives me confidence but I would hate to get all the way there and have it be a problem. Would they give metime to find a new co-sponsor in that case or would I simply be denied? I will give the consulate a call on monday and see what they have to say. I wonder if they would really give me a definite answer though or if its all up to the interviewing officer´s discretion.

You can never have too much for Rio, they might not ask you anything, or they might be very thourough, so a tip from a brazilian (haven´t gone through K1 yet, but I´m from Rio and Rio Consulate is my consulate to get other visas), be prepared to be asked for these. I won´t hurt to bring it, and if not shown, oh well, at least you were ready.

From reading other posts from other embassy interviews they will just withhold the visa until you can submit what they require if you are otherwise approved.

Let us know what the consulate says after you call.

OHHHHHHH........sorry Meauxna, for ignoring your post. It couldve been a trick question or something :P

For everyone that is interested, the attorney basically says not to confuse income requirement with tax returns and just to supply additional info such as the letter from employer and pay stubs and you are fine!
