Question about Adjustment of status and health insurance.

Hello, 

I've seen various threads asking similar questions but none with my exact situation so I just wanted to verify my options.

 

My wife and I will be married next week. She is also a few weeks pregnant. The thing is neither of us have health insurance. 

 

What I've read in other threads is once you're married the out of status spouse can get on the health plan of the other, since I don't have health insurance, could I get a new plan (since they consider marriage as a special condition outside of the enrollment period) and include her in the plan as well?

 

We'll file AOS paperwork shortly after marriage and I'll be signing up for health insurance as soon as I can (and hopefully get her added to the plan as well.)

Yes. Marriage is considered a life event which qualifies for special enrolment. But the window is only 60 days I think

Where do you plan/purchase the health insurance plan? Through work, private sector, exchange?

Insurance marketplace was my thought.

Need to check if your state has it's own health exchange or if it's through the feds. I would reach out to them to see your options.

Visit heathcare.gov (aka Obamacare, aka the Marketplace). Pregnancy, marriage and recent immigration are all qualifying events to enroll for both you and your spouse. If needed, they will forward the application to your local state Medicaid office from there.

Just posting as a follow-up for anyone else who may have my question. I've applied on healthcare.gov and I qualify for special enrollment because I got married, but they expressly prohibit covering my wife as she is out of status.

 

I'm not sure how so many people got on with their spouses employers insurance because from what I'm reading/being told it's not allowed. Very disappointing ☹️

We did K1 visa path. We arrived to US, got married, I went to my employer to let them know (life changing event) and added her to my health insurance. Did the same thing when we had kids.

 

What's your wife's current status in the US? I'm guessing she/you haven't applied for permanent residency yet as you just got married. Until she applies, she won't have the document that qualifies her to use the marketplace.

 

Immigrants with the following statuses qualify to use the Marketplace.
