Hello everyone,

I believe I've made a error on my I-765 Employment Authorization Document and SSN, and want to know whats the best way to fix this. 

My wife has arrived here on a K-1 Visa on 11/2018. We're already married on paper and have the certificate

I've applied for the I-485, I-765, and I-131 together on 1/19. I received my I-131 and I-765 card on 5/19. 
I then received the SSN card that states "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" yesterday.

 

Here's the problem. I realized I made an error and put down her married name onto the EAD card, and it also shows that on her SSN. 

This is a issue when I try to sign her up for insurance, license, etc.. The SSN shows her married name, which doesn't match her current name, since we are still waiting for her AOS to clear. 

 

What's the best scenario to get her name changed on the SSN? I'm trying to debate if it's even worth doing since we are still on track to getting her AOS

I'm sorry if I didn't provide enough information regarding this matter. Any info would help.

There's your problem.

Her married name is her current name. AOS has nothing to do with one's legal name.

 

So what exactly is the problem she is encountering in getting insurance, a license, etc? Her passport is a valid identity document. The marriage certificate is a legal name change document. The EAD & SSN are in her current name already.

Sounds like you did everything right. If she took your name when you married. The wedding certificate shows the name change I would think if that's what you did, and it acts as a legal document that authorized the change of name. I'm my case we got my fiancee at the time SS card the day after we landed, so it is in her maiden name. She didn't change her name when we got married, so marriage certificate kept her maiden name on it, and when we filed AOS, her EAD and AP card came in here maiden name and everything matches still with her state ID, passport, EAD AP card, SS card. You must have waited to get the SS card when you filed AOS, so that is good in one way because it saved you a trip to the SS office to change her name on the card if you had gotten it before you were married. As long as the plan is to keep her married name, your good to go. I am also assuming you used her married name for the AOS also, and that is what you want to do, you want everything to match the wedding certificate. If the wedding certificate shows her maiden name, then you might have to change things back, and you can do that be going to the SS office and showing her wedding certificate. Just depends on what name she wants to use.

Why would you want to change the name on her Social Security Card? Does she intend to use her maiden name as her legal name?

You need to figure out which name she will use, and be consistent. So if she wants to use her married name, and uses her passport as an ID, she will have to explain that her passport is still in her maiden name, show her marriage certificate, and explain what her current name is. Or use her EAD as an ID, which is often accepted. I used my EAD to open my bank account, get insurance, etc.

Yes, at the bank she was denied when I tried to have her name added to my account. They told me the primary document, the passport didn't match the EAD and SSN. They told me to come back when she gets her drivers license first under her current name (my last name).

 Thank you MariekeH, this is exactly the situation she is in. I guess I had a bad experience at the bank. thanks for letting me know I'm in the right direction.

 

By the way, once I receive the date for the AOS interview and approved, do I receive the green card in the mail?

It is a bit frustrating to bring the marriage certificate every time you want to get something in her name, but it'll get easier when she'll have more official documents in her married name. My Dutch passport is still in my maiden name, but everything else (driver's license, bank accounts, credit cards, etc) is in my married name. But it took a while and a lot of explaining to get things registered in my married name, especially before I had my greencard. 

 

Correct, after the interview the greencard will be mailed. I think I received mine 6 days after the interview.

Her EAD is going to come in her married name  as it's supposed to. I'm not understanding what documents you are trying to change her name on? Once your EAD arrives it will be in her married name and it will match the married name on the SSN. Or have you not explain something?

Did you show them the marriage certificate? That is the legal link between the name on the passport (identity document) and the SSN.

 

In general (there are few exceptions, of which this isn't one), a document obtained before a name change occurred is still valid so long as it is accompanied by documentation of the legal name change. Had the EAD & SSN been in the maiden name as well, then there would at least be a valid argument not to accept the married name until those are updated (or you get a green card in the married name).

 

I'm not sure if there are any practical means to compel them to comply, but they are incorrect not to accept that combination of documents. My first suggestion would be to try again with all documents ready, and ask to speak to a supervisor/manager if they are still unwilling to accept it.

So I went back to the bank with her passport, EAD, SSN, Marriage certificate, and Utility bill.

Passport and Utility Bill - Previous Name

 

The banker didn't accept my wife's current name, since they do not take the EAD and SSN as primary identification. I would need to bring in the green card with the current married name in order to open a account with that name. 

However, they did accept the passport and utility bill under her previous name. They required the social too. so she does have a bank account...

Once I get the green card I'll change her name then. Anyway thank you! off to the next one.

Ugh. That's so frustrating! Apparently some banks are a lot tougher than others.

At least she has an account now, that's some progress!

Good luck with the rest! It's a frustrating time, but it'll get better when she has her green card.
