How to qualify to bring my Thai Caretaker/Personal assistant to USA

Well, they won't have work authorization if they decide to overstay.  However, it is true that there is temptation :) many get paid like $200-$300/month or even less for caretaker from many countries  in South/Southeast Asia, it can be $5,000-$7,000/month+ for similar job in US.

She can easily work under the table at local Thai rest or any sushi/Asian rest for $2500+ live in all included

 

Or stay as a caretaker at op neighbour's $2500+per months

The house her mother lives in/the home she lived in previously is irrelevant since it's not where she lives now.  Not to mention, presumably her mother was not her "employer" during that time, anyhow.

 

 As you are visiting family, is there no one else who can temporarily help assist/care for you while you are there?  Or perhaps use the assistance of a visiting nurse temporarily while in the US?

My caretaker worked 2 jobs prior while living with her Mom prior to meeting me. ( She her brother and 2 sisters support their elderly Mother.)  

It is very difficult in USA to find a good hearted , dedicated Caretaker , especially live in.

Also, it is a question of loyalty to my present dedicated Caretaker . She has stood by me, and thus, I will stand by her and not put her in the position to go out in the work world and start over.

Yes, maybe she could, but she is truly a dedicated , honest Caretaker. There is no doubt that she will stay with me in My Employee and return with me after our 3 month stay. ( Also she loves her Family and is very dedicated to being there for her Elderly Mother.)  My Caretaker is an Akaie Mountain lady, and was not raised learning city ways. To this day, her Mother only knows the Akaie native tongue and speaks very little Thai.

It is just something the interviewer considers when you look into her case as there are several cases when people overstayed/got off the grid with their visas: bad people make everything harder for to honest people.

 

Anyway, consider your employment offer (just 3 months work as caretaker), your retirement, and her circumstances, I will say the chance to get one for her is zero. Also, foreign worker sponsorship is not something that easy for a normal person to do, it is normally the work of a lawyer.

I was under the impression from your original post that your visit to the US was temporary? 

 

You said in your first post:  "I have lived in Thailand for a little over a year and want to go visit my Family for 3 months."

 

She might be out of work for a couple of months, or work on a temporary assignment elsewhere while you are in the US---but not starting over in the work world as presumably you would be returning to Thailand?

3 -4 months is a long time. She is very independent , speaks good English, and no doubt she can find work. Thing is : is hard to find good employment for only 3-4 months. I feel it is not fair to put her in that situation, so I will on the least, try my best to keep her under MY Employment. Thank you

I completely understand the position you find yourself in.

Perhaps you can offer her a stipend for those months you are in the US, should she not be approved to accompany you on a visa, to retain her employment upon your return.

Yes thank you going thru.....I am for NOW focusing on qualifying her to go to USA with me. IF...later I find it is not possible,  I will discuss our options with her.
