Hello All,

I have a question, I originally applied for K3/K4 visa for my wife and step daughter using I-129. I also submitted an I-130 at the same time (required to submit both forms). The I-129 was not processed but the I-130 was. Fast forward 230 days, I received my NOA2 for the I-130 and the case was forwarded to the NVC for processing. After submitting the required documents and paying the required fees, I was informed that I would have to apply for my stepdaughter separately because there is no derivative status for step children when filing CR-1/IR-1. My question is, is there anything I can do to get my stepdaughter's Immigrant Visa expedited at the USCIS and the NVC so that my wife and stepdaughter can both interview and immigrate at the same time? My interview date is 06/26/19.

How old are the step children? As of right now you can file for them and try to expedite it but I don't see it taking a month.

Send a copy of NOA2 from mom with the I-130 for the child.  Stop processing on mom's case until child catches up.

File for the child immediately, request an expedite at both USCIS and NVC as others have suggested, and contact the embassy to re-schedule your wife's interview for later after the child's petition has been approved so that they can have their interview at the same time and be able to immigrate together.  Good luck!
