EAD + Crypto Currency / Stocks Question

Hi there,

 

I was not sure what sub forum to put this question hopefully I am in the right place. :)

 

I am going to my interview in a week and a half and after that I will be going to the US. I will have to apply for an EAD after marriage and was wondering are you allowed to sell/buy cryptocurrency & stocks without your EAD card? It's not technically a job but it does generate income in another way but not sure how the government sees it.

I think it is, in fact, a job......it's self-employment.....and yes, an EAD would be required, imo.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I see how stocks could be "self employed" because you may need certain credentials such as SSN etc to buy/sell them.

 

What about Crypto Currency? There is much less regulation regarding it so it may by definition not be considered a job.

I would just keep a bank account in your home country and use the funds from there and not worry about it...

 

 Use that bank account to from any increase or decrease.

 

Of course it's a grey area, It like if you had rental property in your home country and you came to the USA on K1 waiting for EAD, what are you suppose to stop receiving rent from your renter.

What about Crypto Currency? There is much less regulation regarding it so it may by definition not be considered a job.

An EAD gives authority to work and do business in the US.......It has nothing to do with regulation, imo.

Your example is passive......Actively selling a commodity from inside the US  is not.

Hmm, yeah but they may not like you working on US soil at all as far as I know. :P

Trading, such as buying and selling stocks for yourself using your own money is not employment. Doing it for other people and making money from it is employment.

Depends if it is active or passive

 

For example nothing wrong with buying and cars but at some point you become a Dealer.

 

Begs the question why you chose the K1

I think as long as you don't leverage trade and use lenders money you should be fine?

 

Also yeah, I am no day trader. I don't make swing trades. My purchases are passive, and so are the dividends I get paid.
