Hi guys, I would like to ask opinions about the length of transferring files back to USCIS from NVC. The file is I-130 that I’m talking about. I did AOS based on the approved I-130 petition last December. We did the interview well in March and since then are waiting for decision. The only reason for the waiting is the local office doesn’t have our original I-130 petition which was sent to NVC before I initiated the AOS. The AOS interview officer told us they will be able to make a decision after they receive our original petition. And we are waiting for this to happen already for two months.

I called NVC and also put an inquiry through askNVC over 4 weeks ago and they both told me they have returned the petition to the USCIS. So for the original petition file we suppose it should have been sitting somewhere in USCIS. However, we just called the USCIS and even talked to the tier 2 they still couldn't find any record about the file on their system.  Do you guys think this is normal? Is there any possibility the file is missing?

thanks!!!

The file might not been missing , just give it more time , maximum six months which is usually the process of sending file's back to both  the NVC and the USCIS .

Moreover , sometimes it even takes more than six months , and whiles sometimes it can even not reach six months than you get your response.

Wishing you all the best and praying for you in advance on case.
