Hi! I’m just looking back at your post and I was thinking about hiring a lawyer in the foreign country. How do you know that we have to hire a lawyer in the states and not the foreign country?

Hi!! It's just like when they ask for a medical report done by a panel approved physician of theirs. The lawyer will have to work with the US. Therefore, you need a lawyer who passed the bar examination of US.

Got it!! Makes sense!! Thank you for being so helpful. My husband and I are thinking of taking action in 4-5 months. During that time, we would be waiting a year and 4 months. We think that’s a solid enough case. We’re thinking of trying a pro bono lawyer since the fees are so expensive. Did your husband consider a pro bono lawyer before paying for one?

Thanks. Phew I almost had a heart attack reading that. I just sent a request thru the embassy form online as their fax seems to not be working anymore. Was trying fax since it is more of a tracked copy of what we send.

Any update on this? My status changed to same as yours on 13th September so I emailed embassy through their inquiry form/webpage. No update since a week now.

Yeah 16-18 months is a good time for a legit writ of mandamus. Best of luck! Maybe you'll hear sth good before then.

Yeah, I did and I looked up such an option but my mother in law knew a good lawyer who's highly recommended and she said she'll take care of the fees. Which I think are anywhere between 3k to 6k depending on the case.

That’s so nice and generous of her! Thank you so much! Please update us on your entire journey. Hopefully I can hear something good before then. Good luck with everything! ❤️

Oh wow I also just noticed that your lawyer is located in San Francisco, California which is where I am located. Is that where you will come if you get your Visa? If I can’t find a pro bono attorney, I will probably contact your lawyer!

You don't need to wait 12 to 18 months....even 100 days is enough

To file a Writ of Mandamus I heard we had to wait at least a year?

It has to be a period of time longer than the usual. If you look up the longest AP could take 6 months. In some countries they actually send people to ask around and investigate about the person. So yeah a year is the cutoff and longer is better for the case to workout itself in your favor.

No, I'm gonna come to Fairfax, VA.

Like I said you can call her office and have them schedule you that 30 mins free call. You let her know what's going on and what does she think.

Best of luck yall.

Visa Issue after DS 5535

Visa type - B1

Country - Ghana

Interview Date 24 July

After approval at interview, I was given a slip to collect passport in three days. 26 July received email with form DS5535. filled and sent back form on 29 July. Had my passport returned without visa on same date.

Sent two separate email enquiries but no status update.

Symposium organizers (host) sent a letter addressed to the Embassy on 5th September to fast track process.

17th September - Email from Embassy asking me to return passport through DHL

18th September - Status update on CEAC

19th September - Status changed to Issued on CEAC, received text message that passport is ready.

20th September - Went to collect passport

Close to 8 weeks in all

All praise to God. Let us not lose hope. The Bible verse I used as a prayer point for this fight is Psalm 24:1 'The earth is the Lord's, and the fulness thereof; the world, and they that dwell' .

The whole world including the USA belongs to God and I as his child has a right to visit any where my father owes. They that dwell in it, including those working in the Embassy and NVC also belongs to God. He can quicken their work in our matter. Keep praying and hoping. All the best!

Guys to file a writ of Mandamus 6 months in AP is enough. You just have to show the judge you tried everything from self inquiries to congress/senator inquiries. 6 months is plenty!

It's your money to lose.  But 6 months is not long at all, and if it is still stuck on background/security checks, it will be denied.

I don't think that's true...a writ asks for background checks to move forward too

No, it does not.  A writ forces a yes/no decision to be made.  If the data from the background checks is inadequate to approve, the default decision will be a denial.
