the senator received the same reply I get. I don’t see the point of contacting the local senator. This is his second inquiry and he’s still getting the same reply.

No one will get any different reply or make things faster once it is in the dark whole process called AP

I reached out to the attorney above but no response yet.    Any attorney will be glad to help you.  I've been quoted 3500 to 6500 for their help with filing.  The ones who have had a successful outcome on a writ filed to the embassy can only supply me with one case filed through the Embassy and many through Uscis.  They say they filed many on their sites but when asked for information on successful cases they send me information on cases at USCIS for green card issuance and approval for waivers not cases like ours.   All cases like ours that have gotten an approval were in AP over a year and could have been close to approval anyway.   

 

If you are pretty versed in legal garb you can attempt to file one on your own but I wouldn't recommend it.  Catholic charities may be another option.

 

I don't understand if its as easy as filing a petition through the court to get the ball rolling then that would mean they are just sitting on cases.  

 

I've kept a record on every communication with the embassy from start to finish along with their responses in preparation but I'm still deciding if this is the right step.

No, im not working with her and I have never used her services for a lawsuit. I just know this because I consulted her and talked to her over the phone. I also did a lot of research on this topic to see the outcomes and came to a conclusion that there are more chances of winning than losing. I was just thinking about filing a WOM but ended up not needing it. My husband's case was in AP for 7 months and got resolved on its own. The reason why Im sharing this info and emphasizing a WOM on this website is to help people in need of it and educate people about their rights.

I was quoted 3500$ from the attorney who helped me start our process. I’m still thinking about it because financially it’s alot of money And we are trying our best to wait.

I believe we should all file this WOM! It's getting ridiculous. And they are sitting on our cases. They don't have anything on us but they can delay it by not working on it! Simple.

 

As I understand the WOM is anywhere from 3500-7000 dollars in some cases. It doesn't depend on the case as much as it depends on the firm. 

They file the complaint and the DOS, US embassy and who ever else is involved has 60 days to respond. If by the 60th day they do not respond, the court judges in our favor "meaning grant us the visa".

However, sometimes the embassy or the agency that has the case can act stupid and just towards the end of the 60 days period they ask for elongation of the period "couple more months" to stall some more...

 

Being an optimist I believe if we go ahead with this (provided it has been more than a year in AP), we should only think positive and read success stories.

 

May God bring about the good news sooner!

I would love to if we can afford to do so right now... everyone tells me to pray and have faith that God will make a miracle for us. I do pray and believe but sometimes I feel weak. I miss my husband so much. 

I really don’t understand why it takes so long to process an application and in some other countries people get their visas so soon. It’s not fair to single out one group of people. We are also tax paying, law abiding citizens that only want their spouse with them in order to start a family and start their lives together....

I totally feel your pain @NilsaNAnil and I am getting frustrated myself as well.

It just seems like some of us are getting their cases  laid off, like they are not even working on it anymore. that's what seems to be the case with my appliation. NOTHING has changed for me so far after all these months and there is nothing I can do.

 

The worst thing is I don't even know the outcome of the visa considering that they take so long, it's making me pessimistic as I am really scared of getting a visa denied :(

I try to keep positive about the outcome of the visa... I tell myself well if they wanted to deny it, they would’ve done it a long time ago...plus we are in a legit marriage so I’m sure the evidence will show... so you too try to be postive on that aspect.

 

but really I share in the frustration on how long the process is taking. I contacted our local senator and he did his part twice and even offered a third time but he’s getting the same response I get when I email the Embassy so I feel it’s a waste of time... so I will try to contact the congress representative and see if I can get some further help with her... although I feel it will be a waste as well but I feel I need to be doing something. I pray and do what I can. I want my husband home.

I agree with you. What about us who are being delayed after DS 5355? What about our cases? I wish the DOS can explain what’s the hold up.
