NOID after 470 days

Today is 470 days of waiting. And our case status is changed

Notice Explaining USCIS Actions Was Mailed

On May 10, 2019, we began reviewing your Form I-129F, Petition for Alien Fiancé(e), Receipt Number WAC. We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by May 24, 2019, contact the USCIS Contact Center at www.uscis.gov/contactcenter. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. 

Any ideas what does it mean?

Filed: Citizen (apr) Country: Germany
Timeline

It could be anything.

Mostly from what I have seen it turned out as NOID but always with a RFE. Means it stated NOID but the petitioner was asked for more evidence and got approved a couple weeks later.

does the petitioner have any kind of criminal background that would be cause for denial?

it was initially charged with a domestic abuse on a minor. Charge was later dropped to a misdemeanor charge of Assault and battery. A deferred sentence and fines were given. Later had case expunged from record.

were all the papers relating to the case sent in?

Timeline

This has happened before where someone has disclosed a previous 'crime' or what ever you'd like to call it, then the court either drops charges or it's 'sealed', but USCIS still wants proof but the court has no records allegedly. If this were the case you could try searching top right hand side of the screen in the search bar for topics relating to that and see what others have done.

 

But, as others said, until you get the letter you won't actually know what it is all about.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Experience would indicate that even with expungement,  a record still exists.   Did he acknowledge it in the petition or was he silent?

then USCIS wants all the papers as it relates to the case, you need to have him push a little harder at the court to get it, if you don't have it your looking at a denial of the petition.

Hi.  It appears that they were going to recommend denial, however, they will reconsider with more proof.  Domestic violence against anyone, especially a minor doesn't get excused easily.  Even when it is changed to a misdemeanor.  The good news is that I believe you will get an RFE to present more evidence.  Even with expunged cases, USCIS can get access to records that local government cannot.  If they ask you for a report & you are not able to get it, send them an explanation.  I wish you the best outcome.

To say how much we are upset to say nothing 😢😢😢😢😢470days,so much and such a result. When we filled the petition we called USCIS and explained the situation.. They said don't worry and just sent it..

If it is about the criminal part don’t waste time and try your best to get the papers. 

We got a RFE about not checking a box and I made my fiancé to go to court and get info about the case he considered to be ridiculous and not worth thinking about. We were approved within couple of days after they received it.

They just want to make sure you are aware of everything, especially if it was something about domestic abuse. 

And they do ask for everything even if it was expunged. 

Hope you will be approved soon. Stay positive!

Thanks everyone for supporting and help, no patience to be positive, the one good thing for right now is to have news from Uscis after such a long waiting 😢
