This. If the wife wants to pursue it, or even the judge doing the divorce hearing can initiate child support on the OP... and it can be costly monthly. I know people who spend 1/3 their income just on child support for one child. Hope OP realizes this because not fulfilling child support payments can impact their status I believe, but definitely will impact any thought on citizenship, and can even be jailed for lack of payment.

I hope you make a great salary and your child support payments are very high, I as a man could not imagine abandoning my children over bruised feelings

Especially if he is wanting to move to CA. The calculator they use for child support is pretty harsh against those that pay child support. I can tell you that from first hand personal experience. Luckily I ended up getting custody of my children or CA would have hit me for over 1/3 my take home pay for 2 kids.

1. I am planning to move to California alone without telling my wife, can I file divorce in California, right now I have ID of New York. Is that possible to file divorce in CA? To file in a state you have to be a resident right now yuo can only file in NY. You would have to check the residency time for California then once you fulfill that you can file there.

2- Can my wife or my in laws also file a case against me that I move to California without informing my wife? As my wife will be alone when I'll move to CA. No they can't file a case against you. This is the US not prison. And your in laws have nothing to do with it. This is between you and your wife.

3- I don't want custody of our daughter after divorce. Is it possible that my wife keep our daughter after divorce. Yes she can have custody if you don't want it. I am sure that's what she would rather have.

4- I had come to US from Pakistan on IR-1 visa and my marriage was registered in Pakistan not in USA. Is that possible to file divorce without registration of marriage in USA? A marriage doesn't have to be registered here. You divorce in the state you are a resident of currently.

Thanks for reply.

Beyond the one question that is maybe about your status, all of your questions are not immigration related.  Your wife and her family have no control over your status as an LPR.

On a personal note, have you tried marriage counselling or talking to your wife about your issues? Are you really just going to leave your child like that?

No, we didn't try marriage council. My wife fights with me daily. No, I don't want to leave my child like that.

You technically can move without telling your spouse, but it looks suspicious. If you ever file for citizenship expect to be asked why you just up and left and abandoned your child. You do know you have to wait 5 years after green card to apply for citizenship, since you're planning on getting divorced.
