Up to you. But if you are now using your husband's surname, and that's the name that you want to be known by now and in the future, then that's the name you should be using on anything you submit from this point onward.

Seeing as I don't have any documents stating my new last name, should I be keeping my maiden last name for all of these forms until all this AOS stuff is said and done?

I used my own old surname for immigration process. Easier for papers, namechecks, whatever. My passport and drivers license, immigration forms, education records, everything is with my old same surname, so I better make things easier, and for USCIS too. I will change it later to my husbands when all this immigration process will be done.

08/28/2006 - NOA2 - approved

09/01/2006 - NVC - approved

09/07/2006 - Warsaw embassy sent packet 3 (damn post services, never received any)

09/18/2006 - packet 3 sent (Nothing fails)

09/27 - received packet 4

10/10 - medical exam

10/19 - INTERVIEW!

10/20 - received visa

11/7 - arrived in USA, POE YFK

1/19 - Married

02/23/2007 - Civil Surgeon (checked just vaccines for $ 25)

05/04/2007 - AOS package sent to Chicago

05/15/2007 - NOA2 - ASC appointment letter about biometrics

05/24/2007 - RFE about tax forms w-2 and 1099!!!

07/10/2009 - NOA 1 received, GK extended for a year

07/17/2009 - received biometrics letter with my case number

08/06/2009 - scheduled biometrics appointment

11/16/2009 - approval

12/01/2009 - touched - card production ordered

2/26/2010 - got ten year card

I changed it after we got married. I had applied for my SSN right before we got married, and then I went to the SSA with my marriage certificate to have the name changed before they generated the number. I don't really have any documents that proof the namechange, only my SSCard with the married name and the military ID card with my new last name on it..and now my drivers license.

When I applied for AOS, I used my married name as well, since this is the name I want to have on my greencard. I figured that was easier than having it changed afterwards, even that might mean a longer FBI namecheck.

But really, it is up to you.

Using the new surname on forms now will ensure that documention received thereafter will be in your new surname! :) I did that. The only thing I'll have to do is change my SSN after I get my GC, to not only reflect the name change, but the "not to work without DHS authorization" to be taken off. I did it this way so that I'd only have to go back to do this change once with SSN.

Could I use my wife's surname for AOS even though on the marriage certificate it will say that both of us keep their surname? It'll take about 6 weeks for me to obtain a new passport with my wife's surname...

I don't know, I only guessed. Or do they only have the old names on them? I should've written "marriage license" ;)

Maybe it depends on what State you marry in? On our license, there is nothing on it but our names, as typed in by the "State". We didn't even sign the license. Just the witnesses. There was nothing on the license at all that stated that we had to use certain surnames. Matter of fact, no where on the license does it state anything other than my maiden name, and my husband's name. (first and last).
