hello everyone, i just want to ask a few questions about 1-129F petition..kindly help please..

1) on the documents to be submitted, should i really send my birth certificate too? (i'm the benefiaciary)

2) i'm looking at the form 1-129-F i downloaded, it and it looks like it will expire this june 2006, still ok to use if will submit in august?

3) also is it ok if the forms were of different dates when u filled them up? like for example, you filled them up and dated july, and submit in august, is that ok?

4) the FC-029, it won't matter if on different sheet or on cover letter?

5) the letter of intent to marry from petitioner and beneficiary, can anyone show/post complete sample of "each", or are they of the same format, other than sample found here please? i'm a bit confused of the address to be used.. i'm thinking, the letter of intent of both petitioner and beneficiary will be addressed to the: United States Department of Homeland Security U.S. Citizenship and Immigration Services , (USCIS service center address), that is understood.. what about the part:

or when submitting for interview

United States Department of State

United States Consulate, [name of country where Embassy is located]

[Embassy Address]

this address is going to be used when? after receiving the k-packet? only benefiaciary will again make a letter of intent to marry petitioner addressed to the consulate and not anymore include USCIS and submitt it together with the required documents listed on k-packet during interview? or both addresses, USCIS and US consulate of country where embassy is located, should be present either when submitting for 1-129F petition or for interview?

6) if i follow the format of the letter of intent found here, ..this is the petitioner speaking..

" and intend to do so within 90 days of " my " arrival into the US using the K-1 visa".

should "my" be changed to "her"? ... to marry (beneficiary's name) and intend to do so within 90 days of "her" arrival into the US using the K-1 visa.

thank you , looking forward to answers - aix

1. Beneficiary Birth Certificate is not a requirement. The USC is required to send either BC or copy of passport etc to prove citizenship.

2. If you downloaded the form from USCIS or from the link on VJ which is linked to the USCIS then this is the latest revised edition and will be usable for quite some time past that date.

3. Yes.

4. The FC-029 is an obsolete form and no longer required.

5. The embassy address is used for the letter of intent submitted by both of you again at interview stage.

6. The letter of intent on VJ is an example which has been used by many members. You insert/change the words to suit.

1. NO. The USC needs to submit a copy of his B/C to demonstrate that he is a US Citizen and entitled to file the petition.

2. Use the form that is available when you file the petition. Even if it has expired they will still accept it unless they design a new mandatory use form.

3. Date them as of when you send them.

4, They dont use the FC029 anymore. Just make sure that you submit a cover letter stating what it is that you are sending, and that you are submitting copies of original documents that you have in your possession, and will be available for inspection at the time of the interview.

5. Use the sample show on this site. Change the address to reflect to whom you are sending it too. You will prepare another letter addressed to the Consulate when you submit your visa application to the Consulate.

6. Of course.

you had to beat me by thirty seconds didnt you AussieWench!!!!!

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

hahahah! I was confused by the mention of the FC-029 in the sample cover letter... so just to be safe I downloaded it, printed it, signed it, made two copies, and stuck it in with everything else in my application packet.

I guess it wont hurt that I did that... just thought "better safe than sorry"... but if you don't HAVE to...

Aussiewench and desert fox answered them very well. I have one more ting to add. The petitioner, the US citizen in this case can submit a copy of birth certificate or copy of passport or a copy of naturalization certificate (if the USC was not born in USA). It is perhaps easier to submit either the copy of birth certificate or naturalization certificate (depends on which one is applicable to the USC) instead of copy of passport. One has to photocopy the whole passport which has many pages.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
